Public Defender Careers: Federal Defenders, PDS and State Offices

Short answer: Federal defense is provided by 83 authorized federal defender organizations, with about 4,200 staff serving 92 of the 94 federal districts (uscourts.gov). Assistant federal public defender pay usually matches that of AUSAs with similar experience (sample FPD announcement). Entry-level routes include the Defender Services fellowship, Gideon's Promise and the D.C. Public Defender Service's fall hiring (Defender Services) (Gideon's Promise) (PDS).

Fast facts
  • Two models: federal public defender offices are part of the judiciary; community defender organizations are nonprofits funded by federal grants (Defender Services).
  • Count check: uscourts.gov lists 83 organizations (uscourts.gov); the Defender Services fellowship site lists 82 (fellowship site).
  • AUSA pay benchmark (2025): AD-21 (0 to 2 years) $63,163 to $107,376 before locality; total pay with locality is capped at $195,100 (DOJ USAO).
  • Public defender medians (2023): $69,608 entry level, $90,000 at five years, $106,883 at 11 to 15 years (NALP Bulletin, May 2024).
  • Gideon's Promise 2027 cycle: applications June 1 to Oct. 2, 2026 (Gideon's Promise FAQ).

Public Defender Service for D.C.

PDS hires entry-level and lateral trial attorneys once a year through fall recruiting. Applications open in late summer and close in early fall. Final-round interviews are with PDS leadership in December, offers go out in December or January, and the class starts the next October. Pay: n.a. on the recruiting page (PDS).

Gideon's Promise Law School Partnership Program
  • A single application gets you interviews with multiple partner offices. More than 120 graduates have been placed since 2011 (Gideon's Promise).
  • Your school funds up to a year. The office commits to hire you for at least three years, and you enter the three-year CORE 101 training (Gideon's Promise FAQ).
  • You need a resume, two letters, a writing sample, an unofficial transcript and essay answers. Fellows start after the July bar, by Sept. 30, 2027 (Gideon's Promise FAQ).
State and county offices

State and county defender offices hire independently, so check each office's own site. A statewide list is n.a. in this edition. For comparisons of offices by trial experience, see Best Public Defender Offices to Try Cases; for application timing, Public Defender Applications - 2022, Public Defender Applications - 2021 and 3L Public Defender Applications. Federal versus state is discussed in Federal Public Defender vs State Public Defender.

Defense or prosecution

Many candidates weigh both; see AUSA or FPD, Graduate: interviewing for both prosecutor and PD positions and Are prosecutors more respected than public defenders?. For the prosecutor side, see the AUSA hiring guide, the government jobs directory, Where are the best District Attorney's Offices in US? and What are the top 5 most prestigious USAOs?.
