We're both applying to UC Hastings, University of Washington, UC Hastings, and GW.
You would have a slightly better chance at those schools, but not by much, and only because your 3.8 is near most of the 75th percentiles. (Berkeley degree is irrelevant.)

Good to hear you're both going to retake.
