I would probably retake. I mean if you have test day anxiety and you scored 3 points below your PT average, that is pretty good. I would prep more and if you can raise your PT average to the mid 170's or better, then I would go for the retake. Also, even a 1 point increase (to 170), would make a big difference with the lower T14.
Law schools won't care about grade deflation (esp considering you have a 3.93). Your GPA isn't what is holding you back, your LSAT is.

Thanks for the response bk. I'm leaning towards the retake now, but I just wont have time to do it in February or June, so its kind of rough, I was hoping to get into the next cycle and be able to apply early decision... Berkeley seems to be thrown around a lot as a school that cares more about GPA, so I'd also really like to go there if I have a shot. Guess I got some thinking to do...

I don't think taking the October LSAT is going to set you back that much. I guess if you really value applying early, you can apply early, see what happens, and retake/reapply if necessary. The latter path I guess would depend on you, hypothetically if you got Boalt you would rather be Berkeley class of 2015 or have a retake/reapply for the possibility Columbia class of 2016? Just something to chew on.
