I think ED gives you a shot at MVP. If you're going RD, I would apply from Berkley down.
How many times have you taken the LSAT, though? A couple more points and you're looking at CCN and up.

I have similar numbers 3.93 / 168. I'm retaking in Feb unless I get into my ED school -- just don't have the energy with my schedule to prep properly for the Dec test. It might not be considered this cycle but if you do well enough you can just reapply next cycle or use an improved score to get you off a wait-list. Definitely shoot for MVPD ED if there is a school that you know you will realy like.
For top 14 everyone ranked Berkeley and below. You (and me) don't have a great shot at Chicago but it might be worth the gamble so what the hell? According to LSP your best shot is ED to Duke but I wouldn't recommend EDing somewhere that you weren't 100% on. You should definitely get into Cornell so you should have at least one top 14.
