If you're out-of-state, you should ED. If you're in-state, RD is probably decent odds.

would that also be true if the applicant had those stats and was a URM out-of-state?

I have almost exactly the same stats but my 170 was a retake and I'm in state. Does the retake affect my odds at all?
I love UVa but am too commitment phobic to ED anywhere.

UVa should take the highest score. If your highest LSAT score is 170+ and you're in-state your odds are incredibly good. In-state people fare much better than out-of-state.
