This is inaccurate. You have to live in Virginia for one year prior to your first date of classes. My understanding is that UVA is not supported by tax dollars, although the school does receive a stipend from the state for each in state student, which accounts for the difference in the IS and OOS tuition ($5k). That really doesn't add up to all that much money, however. 40% of a class of ~350 x $5,000 = $700,000, or about three tenured professors' annual salaries. When I asked admissions about the in state policy, I was told that they are actually not required by the legislature to fill 40% of their class with in staters, unlike UNC Law which is required to reserve 60% of its class for North Carolinians. The implication was that the school prefers to maintain this 40% quota to ensure that the VA General Assembly continues to mind their own business and the school doesn't find itself being run from Richmond. Take that for what it's worth.

So I'm ED Michigan, and should be hearing by Dec 15th whether I'm admitted or deferred. If deferred (probably likely), I plan to switch my ED to UVA...I know they let in lots of people with my numbers (177/3.1, OOS) earlier in the cycle, any clue as to how I might fare now?

Just got accepted today! Got an email saying to call, I thought that it might be an acceptance but also worried that something was wrong with the app-- does anyone know when they will send scholly info?? Oh and 3.87/174, and I wrote a Why UVA essay

If you had better GPA/LSAT either it won't matter to UVA or UVA won't matter to you, or both. It may actually help you less as OOS. Although, the way it's looking, if you don't apply ED OOS you are fighting an uphill battle.
Also take a look at the LSN graph. All splitters of both varieties. People who are above both medians are not receiving anything. If I had to show you a picture of YP this would be it.
