Does anyone have any advice on whether it is worth it or not for me to (pay to) apply? I can't decide.

Non-URM, plus softs, LSAT is at the mean of their 25/75, and GPA is just a bit above their 25.

I suppose a "20%" chance of acceptance would be worth the fee... any thoughts?

If I were you, I'd at least try to retake first. A 169 will put you in the "Definitely Apply" space.
I'm probably going to retake in February. I have a family, too, and I couldn't really bear to neglect them for another consecutive month and retake in Dec...

My errors were mostly stupid that I'll chalk up to nervousness.. I'll shoot for and expect at least a two-point bump in Feb. -- would it make sense to wait until I get that score back to apply to Penn, then?

If you're taking in February, it might be best to apply in mid-December/early-January. They won't reject you before you get your February score back and they say on the admissions site that they consider LSATs that were taken after you applied.

I know Penn typically notifies people via phone call, but then why do they say this on their website?

"All final decisions will be viewable through Penn Law’s Online Status Checker and additionally sent via email. For confidentiality reasons, we do not give decision information either over the phone or in person at the request of the applicant."

Is this new to this year? Or did they always say this yet still do the phone call?

No idea, I've been reading last year's applicants thread and people started getting in on the first friday of december, which was december 5th or something.

According to the thread, most people had two 'under committee review' updates, I think I've only had one so far, updated november 20th.

If my current ED at another school doesn't work out, do I have the ability to change my RD application to Penn to a round 2 ED?

If not, should I wait to submit an ED app or submit an RD right away?

I think you do. You need to send them a request in writing, along with the ED agreement before the ED2 deadline.
