Lol literally already had this up and currently reading it.
I worked for a state legislator trying to extend protections to LGBT+ individuals at the state level where I live last year and it didn't work out, so I'm looking forward to seeing how this all works out in the courts.
Ugh I love all you brilliant, activist/progressive-minded nerds. Can we go to school together?

Posner's concurring opinion is also *fire*

"We should not leave the impression that we are merely the obedient servants of the 88th Congress (1963-1965), carrying out their wishes. We are not. We are taking advantage of what the last half century has taught."

Also, the idea that "homosexuality is nothing worse than failing to fulfill stereotypical gender roles" is a...unique(?) take.

Posner is amazing. My fav was his shade at Fox News re: sexual harassment.

Ah, how sad that most cases won't be this fun to read...

Yeah I feel like even when the courts are trying to advance LGBTQ rights they often end up doing these very bizarre rhetorical/legal back bends to get there. And then the next page he's like, look, we've realized that gay people can be nice too. Like, Oscar Wilde and James Baldwin and stuff. Also a little :?: :?: :?: but like okay fine WE'LL TAKE IT ...

Clearly everyone else commenting on this page rn will be skipping OCI and will be having a separate bra burning pizza luncheon. So no problem in that regard

I completely agree about the strange backbends. On the other hand, they have to do those backbends, though, because the legislative branch hasn't done their part to keep our laws reflective of 2017.

Also, the argument that the concept of sexual orientation wasn't a thing in 1964 seems a bit dubious considering Stonewall was just 5 years away...but I'll take the backbends for safety!

Don't get me wrong, I'll take the backbends. I'm also not good enough at law yet to understand if they're primarily rhetorically backbend-y or legally/technically backbend-y. Or maybe those are inextricably linked. I guess the legal framework from which they're working (Title VII etc) is just unclear and leads to a bit of both.

IDK, I need to go to law school and more learn stuff

agreed. also LSN likes to play itself like a serious/helpful website, but it doesn't even allow people to timestamp their decision down to the minute. so like, how helpful is it really

Far worse are the people who update with "pending" right now. Like, they make me thing another wave is happening.

That is one cute cat. Sidenote: in my right sidebar under where it says BBcode is on it says Img is off and I can't post images or gifs. Anyone know how to fix? If I try it says "You cannot use certain BBCodes: [img]."
