Yeah I feel like even when the courts are trying to advance LGBTQ rights they often end up doing these very bizarre rhetorical/legal back bends to get there. And then the next page he's like, look, we've realized that gay people can be nice too. Like, Oscar Wilde and James Baldwin and stuff. I completely agree about the strange backbends. Don't get me wrong, I'll take the backbends. I'm also not good enough at law yet to understand if they're primarily rhetorically backbend-y or legally/technically backbend-y. Or maybe those are inextricably linked.
