What will the future of AUSA hiring in NYC under the Trump administration bring? Will there be less applicants? Less spots? A dramatic increase in hiring if Dems win in 2028?

I mean, currently there’s no hiring, and an EO declaring that hiring will be one replacement for every 4 people who leave, so…

That said, under Trump 1.0, after the initial freeze, there was a lot of money for USAOs to hire, as Republicans tend to like law and order type of things. This time around, though, absolutely no way to tell. Sessions and Barr were old-school federal prosecutor types in a different mold than Bondi.

I doubt there will be fewer applicants for whatever slots there are, they will just likely be different applicants.

If Trump and Bondi succeed in using the
USAOs to go after political enemies, and Dems win in 2028, I’d be very surprised to see a dramatic increase in hiring under the Dems. It will depend on how many people who are currently in the office leave under Trump, and if they’re replaced by pure political loyalists, what those replacements decide to do if the administration changes. A lot of that can depend on who gets installed as USA.

The EO exempts “law enforcement” from the ratio. And it defines “law enforcement” to include the “prosecution of . . . any violation of law.” It also exempts immigration enforcement, and they’re gonna need more AUSAs for deportations. Still, nothing’s for certain.

Yeah, those loopholes were significant last time around; it’s just not clear at this point how much that will make a difference here given the whole tenor of things so far. Maybe there will be a push to expand SDNY/EDNY or fill them with loyalists, who knows.

Though to be clear, AUSAs don’t have anything to do with deportations. Bringing criminal immigration charges is obviously something that those in support of cracking down on immigration love, and may well support hiring more prosecutors, but it doesn’t bring AUSAs under the immigration enforcement umbrella.

Well, the USAO's civil division needs to respond to immigration-related suits brought in district court, including mandamus petitions
