When seeking legal advice, it's probably better to ask a lawyer than to ask a future lawyer.
I can't tell you what's legal or not. However, I can tell you that LSAC doesn't like this sort of thing and will likely ask you to stop if you do it. My understanding is that *they* consider it to be copyright infringement.

I know other publishers have done this, I remember seeing a book published by some no name LSAT company and realizing that all the games were eerily familiar because they were just taking old LSAC games and re-writing them with different words. This was way back when, before licensing LSAC questions became standard for third-party publishers.
I'm not a lawyer, so I don't know, but my hunch would be that this is not copyright infringement because you aren't copying any of the words, you're creating a new work. The ideas are the same, but one thing I do remember from my copyright class is that you can't copyright ideas. However, I zoned out a lot in that class and didn't get a good grade, so take it for what it's worth.
