It comes down to Kennedy, who has been a huge proponent of expansion of gay rights (see his opinion in Lawrence v Texas). He's big on expanding the substantive legal right to what he calls "human dignity" so I would be amazed if he didn't rule with the libs. I think Roberts might swing only because he made one comment during oral arguments that bans on SSM might amount to sex discrimination, and if he swings he can write the majority opinion and tailor it narrowly, since the Chief gets to assign the opinion if he's in the majority.

I'm more interested to see if Obamacare survives its second pass under the Supreme Court; we should be getting that decision any day now
I agree, it just seemed there was a sense of caution. There have been so many cases decried as judicial legislating and it seemed they are aware of that and don't want to go to far overriding legislators. There was a lot of, why should we cancel out these democratically approved laws and not let states decide.

What I find interesting is how so many people are so preoccupied about arguing about Gay Rights. Honestly, as a strait male, it doesn't affect me at all. In my opinion, if you couldn't guess by my picture, I generally believe that the responsibility of decisions should fall on the individual rather than the government. I don't think it is the government's job to tell person X they can't marry person Y. Now if a church disagrees as a private institution then they certainly have the right to refuse to marry people.

I think there are so many more important issues to be focused on such as the fact that we have had interest rates at .25% for 8 years and are running both monetary and fiscal policies that are unprecedented in the history of the United States. I can't begin to understand why so many people are bickering or even voting on the basis of gay rights. Let them get married and let's move on to other issues that are more pressing.

I took what EnderWiggin meant as referring to letting states decide on gay marriage, and states usually do that with a referendum.

ETA: Ender, please correct me if I'm totally wrong.

but that is what has happened in any state that has held a gay marriage referendum (either to ban it or to permit it). And in Ireland.
