Sorry it's in the wrong forum, but is there anything constructive? I'm just trying to understand what the hell I'm supposed to do and I'd appreciate earnest guidance. I don't mean to piss people off, I'm just nervous and trying to wrap my head around some things that seem like they would be worthwhile to understand.
I know it is a long paragraph, but I don't know why you would hate on it, I don't really understand what function that serves. If you find it laughably bad, just enjoy it to yourself, if you have something useful to offer on the topic, please let me know.
Thanks.

Here is my advice, honest and sincere: Don't think about it so much and don't worry about it. Whatever your dilemma is, just forget about it. I barely even know what the hell you are talking about and yet I did very well first year. Go figure. So please, go out and have some fun and stop ovethinking things which you need not consider yet (if ever).brickman wrote:Sorry it's in the wrong forum, but is there anything constructive? I got about half way through, and then I started screaming. It was a desperate, hateful, self-loathing burst of emotion. Eventually the screaming subsided and I just started crying. Well, more like wailing. My roommates were freaked out, they thought I'd just had a family member die or something.

Your prose, it glows. You have spoken in a manner which reflects both your gargantuan intellect, as well as your station in life. I find your musings on law school thoughtful, and whilst others here may act haughtily, you answer them only with an amiable response reminiscent of a time where rhetoric meant something. I ask you this, OP: dare I eat a peach?brickman wrote:Sorry it's in the wrong forum, but is there anything constructive? Arms that are braceleted and white and bare

Is my entire thread just a terrible premise for reflection? It doesn't seem to me, but I guess I'm really not in the best position. And I'm thoroughly enjoying my summer, just got back from a month of riding bikes in Denver, I was just reflecting on it tonight and thought I would ask the community for their thoughts.thesealocust wrote:This was pretty sincere, so I felt a little guilty and went back to look at your original post.brickman wrote:Sorry it's in the wrong forum, but is there anything constructive? What exactly are you getting from a professor that is relevant and what should you be looking for to make sure you do well on the exam. Further, is this a correct way of thinking about the type of things that are relevant to exams and how far and wide should this methodology be applied to the material.AreJay711 wrote:If I understood you, you might be right in my limited experience. OK, I forced myself to actually read the OP.
No, you're wrong. Professors talk about whatever the feel like to make themselves feel smart in class, which may at times have anything to do with the law. Rare is the class where paying careful attention beyond making sure you don't miss entire topics help your grade. Yadda yadda ambiguity good. Law professors are there to make sure you suffer and get sorted for employers, not teach you. Never forget that.

So just read some supplements and collect old outlines and build my own and take practice exams and all that jazz?thesealocust wrote:OK, I forced myself to actually read the OP.

Just learn the law, then apply it to facts. There are at least a half dozen good ways to learn the law, figure out what works for you. Practice exams will help you practice applying law to fact but make sure to really dissect them when you're done.brickman wrote:So just read some supplements and collect old outlines and build my own and take practice exams and all that jazz?thesealocust wrote:OK, I forced myself to actually read the OP.

People ace classes they never even attended in law school. Profs rolling around on the floor screaming "BUT WHERE DO WE DRAW THE LINE???" while the gunnery sergeants in the first row mud-wrestle for his attention doesn't add much to the experience outside of contempt for your fellow man.

Re: Musings of a 0L on lecture purpose and methodology
The most important thing to glean from the professor is his coverage, i.e. what material she does and doesn't include in the syllabus and what she does or doesn't emphasize in class. Know all the material that the professor chose to cover in his/her course. Nothing less, and preferably nothing more. Pay attention to whether the professor has any kind of legal philosophical bent or slant on certain issues (e.g. takes a very skeptical view of punitive damages in x kind of case; thinks y judge's ideas in a certain case about a certain rule are way too flexible or way too narrow). If you want to take things up a level, it can help to read law review articles that the professor wrote about anything covered in class -- gunnerish, yes, but very helpful.brickman wrote:

The professor in most cases isn't going to "lecture" the way you (I think) mean it -- they're going to ask people in the class a series of questions about the assigned cases, i.e. some loose version of the socratic method. The professor might sometimes lecture and might sometimes introduce historical background (esp. in con law) or legislative history where applicable, but that's not where you should focus.
The #1 thing you need to be concerned about is making sure you know and understand the rule/holding from every case you cover, particularly the cases you read in full (as opposed to the ones you read a brief summary of, but knowing those will get you extra points). If you do cover any statutes or code, you should know those too, of course. This means understanding precisely what the rule means and doesn't mean, understanding it thoroughly enough that you can apply it to new facts, and being able to see where the rule breaks down or faces difficulties because of situations that test its limits.

I had one professor who really cared about helping students do well their first year of law school (and helped in terms of giving summer job advice and future scheduling advice). Though that same professor wrote a final where one of the three questions revolved around a trick scenario that over 9/10 of the people in class missed (and had much less to do with understanding the law than with being able to catch a very subtle fact in the fact pattern). Ah, law school--where even the professors that truly care about the students still make the vast majority of them cry.
