You have to realize most classes are not about active participation. The prof cold calls a person and interacts with him/her, and that's part of the teaching. Every now and then it's fine - when the prof looks for volunteers or when you need to clarify a point, and most especially when you are called on - by all means, speak up! But there isn't room (in your average law class with dozens of students) for 'active participation' unless you win the Socratic lottery.
