Nah, I could analyze Erie using my flowchart. I overlooked the fact that an issue regarding Erie existed within the question, it was very discrete and I overlooked it in the moment. A lot of my classmates missed it too, but some nailed it.. :/ combined with messing up on SJ by using JMOL I'm scared that I don goofed hard.. at least set the ceiling of my exam at an A- due to missing those issues.PeanutsNJam wrote:What does missed an issue on Erie look like? I just straight up didn't know that there was a federal rule on point prescribing discretion on how to handle trade secrets in discovery, so while I spotted the erie issue, I botched it. That's a way to miss it I guess?

Civpro is my last tomorrow, going to celebrate with some of my cohort and other classmates/schoolmates, then not stepping in this building again until Jan 1. I'll probably not post on here either.
I've got a Santa run in Cedar Pointe on the 20th, helping a friend celebrate his swearing in as a US Citizen next week, then hitting a concert the day between J-Term and Spring. Between all my normal stuff and those extras I'm going to be happily distracted.

I'm not saying I'm some sort of Erie expert, just that it's not as simple as most people think, and if you do a Google search for Erie flowcharts, most are flawed.

understanding concepts, and understanding concepts to the extent and manner your professor teaches them, are different things. Only the latter is necessary for an exam. When there's a 5/4 split opinion, no shit some random 1L will not understand the full extent of the nuance that goes into an Erie analysis, but you're not writing a supreme court opinion for your exam answer.
I bet if you gave a supreme court justice a 1L final exam, he'd end up below median.
