I am hoping that this is the case. The hypo was basically a toss up battered spouse syndrome self-defense claim where the wife spends time researching and preparing a spring gun trap for her abusive husband and you are placed in the position of her defense attorney trying to get her out of 1st degree murder. I hit the whole battered spouse syndrome defense (Leidholm) as hard as I possibly could to get around imminence. The pattern stated that the wife spoke harsh words to the husband, who ran upstairs swearing, she heard a bang, went upstairs, found her husband in a pool of blood, then called 911. There was nothing in the fact pattern to indicate how exactly he died, so I went with possible suicide instead of the spring gun and pointed to that as a possible independent intervening cause of death that could exculpate the client. Took it and ran with it like hell. I missed pointing out the greater likelihood that the husband was killed by the spring gun. FML
Based on the grading rubric, there is no cap on points and we can get points for making thorough analysis. Maybe it's not a lost cause, but I certainly don't feel good. The whole exam was basically an outline dump and I think the curve is going to be pretty tight.

Oh well, it's done and there's nothing else that can be done. I felt so good after crushing the practice tests, but the actual test was quite a bit different than I expected based on previous samples. One more exam left this Thursday.

I put 4000 words down yesterday assuming some guy died. Had 20 minutes left and realized the next to last line said, "He's in a coma, and doctors don't know if he will survive."

I've got one hell of a homicide analysis.

I saw a Cali exam answer and I know now I will never come close in this lifetime lol. The amount of work you have to put in is beyond me.

At least y'all have Cali answers to look at. Two of my teachers have never taught these specific classes before and one doesn't believe in providing student model answers. Even without seeing any top student answers, I feel pretty confident saying that mine will not be "the one."

I honestly think if you want to Cali, you have to go beyond the "apply the law to the facts." That might get you above median, but if you want to beat others, like the top exam answers all discussed rationale in cases in their analogy.

Maybe A- answer: "The BLL rule is this. Here is an analysis of the facts as they apply to the elements of the BLL. Case 1 had these facts, and they held P wins, and since the facts are similar to the ones here in these ways, our P might also win. There's this minor difference that D can argue, but it may be inconsequential. Here is an argument D may try to bring forth that I'm pulling out of my ass, vaguely recalling something we discussed about a dissent in some case."

Cali answer: "The BLL rule is this. Here is an analysis of the facts as they apply to the elements of the BLL. Case 1 had these facts, and they held P wins. The facts in the problem are similar in these ways. The court reasoned that P should win because public policy reasons X and Y. However, in Justice So-and-so's dissent, she argued that this other thing was just as important. In the facts given, D did these things, and the dissent would argue that he should win because he did those things. While the facts do not line up as neatly with Case 2, the court considered the effect of public policy reason X, adding this other new perspective, further strengthening P's argument that he should win. (Go on for another 2-3 pages of this shit.)"

depends on the exam imo

I had a 4 hour closed book 2 question exam with 2000/2300 word limits, respectively. Had all the time in the world to outline and think, cause of word limit. Professor recommended spending half the allotted time outlining, but 1/4 is more reasonable. It doesn't take long to type 2000 words.

I'm about to have a 3 hour open book exam with lots of questions (like 6 short answer and 2 fact patterns with 2-3 questions each), so I'm just gonna be transcribing my attack sheets. That's like more words more pages more hoes.

Probably not super helpful, but I've moved towards about 10 minutes of outlining for every hour of test (more or less), because right now I'm doing fine on time management but would like to improve clarity and comprehensiveness. Basically I think it comes down to where you think you fall on the quality v quantity spectrum.

Also keep in mind that Strahilevitz said he wants slightly shorter essays in favor of word-vomit so that might be influencing my thought process here.

I just write down the issues (in one or 2 words, like battery, assault, etc) in a list before I start typing just so when I'm brain dead from typing for an hour I can make sure I checked all the issues off. Outlining more than that seems like a waste of time IMO

I outlined all my essays and then copied and pasted the outline below itself. Then I'd expand the top outline into sentences, leaving the bottom outline there in case I ran out of time. I will say that I did very well in law school with the exception of two classes that were the type of single-question issue-spotters where everything covered that semester was included in the facts and the longest answers got the highest scores. Most of my profs, however, favored organized, concise answers that addressed the particular call of the question. It's all about knowing your prof, I guess.

The test I took yesterday was four hours long with a mandatory 1.5 hour outlining period. I think outlining was extremely helpful and I've been doing it for practice tests that don't have that time built in. It keeps the answer organized and makes sure that you don't screw up your analysis by trying to answer as you go and finding/figuring out something near the end that drastically changes the answer. In 2.5 hours of typing time, I got out 6000 words so I'd say there is almost always plenty of time to get a long answer even after outlining.

I don't know what class yours is or how it is organized four but 5k-6k in 3 hours with outlining wouldn't be bad if it was only one fact pattern.
