newyork bar MEE---subject of wills

Post by leeyatong » Thu Feb 14, 2019 11:35 am

Hi, everyone, as to the newyork bar exam MEE, I feel really tired of the preparation of the subject of wills. There are so many majority rule and minority rule and the UPC rule, and the results of application of different rules are different. so

when I organize the answers of the wills essay, how can I organize the conclusion part? because different rule, different conclusion, can I just choose the UPC or majority rule or common law rule? Thanks so much.

Because it's the UBE, you'd be perfectly fine with stating the UPC rules. The fact that you're taking it in New York should be no different than if you were taking it in any other state; that's one of the benefits of the UBE. You'll notice that in some of the model answers, the NCBE will cite to minority rules and so forth, but the UPC rule is always included. And so that isn't to say that there are no points to be awarded for knowing that the rules can differ, but knowing your UPC rules will be sufficient to score high.
