Cheating on the bar exam
I just took the bar exam and saw some thangs.
The person sitting next to me was staring at the scantron of the person across from him. I know both well. They are my classmates but I am not close with them. Anyways, I know they cheated.
There are “forms” (1-10?) on the MBE. Will they get caught by a scantron machine? Should I report them? Is reporting anonymous? What are the penalties?
Thanks.

That’s dumb. Big risk in case it was a different scantron. Depending on how many questions the other person copied they have programs that can pick up anomalies.BarAttackIL wrote:I just took the bar exam and saw some thangs.

Re: Cheating on the bar exam
There are multiple test forms (I think 10 is correct). Both exams I took (two states) the test versions were distributed in such a way so that the people next to you had a different version. If he did cheat, his score probably won't be what he expects.
That said, you have an ethical (and maybe moral) dilemma on whether you report what you saw. Regardless of the fact that if he did copy off someone else he will probably fail, this raises questions of his ethics as an attorney. Reporting what you saw would probably open an investigation, which is likely to catch any illicit act (if he actually was cheating). Only you can decide if that is the course you personally would take.

HA. Hope that the idiots tried to copy. Trust me. They alternate forms so people near each other get different versions of the MBE. Same questions, different order. No one near you has the same form version.

Always someone. I remember 2 years ago during MEE I was pounding out essays and all of a sudden I look up and there are 6 proctors surrounding someone and in a flash a supervisor was escorting the guy out and a person in a suit was holding the guy's laptop and his name was removed from the table. Did not return the next day.snowlock wrote:HA. Hope that the idiots tried to copy. Trust me. They alternate forms so people near each other get different versions of the MBE. Girl next to me would write for a good 30 seconds - 1 minuet after time was called. Like 3 proctors for sure noticed because they stared right at her, but just walked away.

Re: Cheating on the bar exam
I wouldn't report it. I doubt you can know for sure they guy was actually cheating. If he was sitting next to you how could you really tell where his eyes were looking at? And even if he was staring at the other person's scantron, you don't know that he wasn't just absentmindedly staring off into space.
If you're wrong, you will have ruined an innocent person's life. Just let it go - its not your job to be the morality police.

agree with this. if you were absolutely certain (e.g. you saw someone with a phone out in the bathroom), then there is a stronger obligation. but don't ruin someone's life when you could be misinterpreting what was going on.rustyburger2 wrote:I wouldn't report it. Plus, they have different MBE forms just to avoid that. If the guy was cheating, he didn’t know about this, I assume. His punishment will be failing the bar already, no need to report. Also, I doubt anyone at the bar would care because of the same reason.

Is there something about not allowing someone to sit for the bar for a certain number of years?Nightcrawler wrote:This.rustyburger2 wrote:I wouldn't report it. Re: Cheating on the bar exam
I always wondered what stopped someone from hiding like a small review sheet in their pocket or bra and going to the bathroom (besides being a good ethical person?)
And honestly it’s inevitable to not see some else’s sheet at times. But, 99% it’s going to be a different form than yours. For example I was mid MBE looked up and the girl in from of me had her answer sheet way off to the side in the open. I saw the answer patterns didn’t look anything like mine, freaked out, saw my professional career flash before my eyes and then laughed because I remembered we all have different test forms. Mind you this all happened in .3 seconds.
I definitely think cheating is real, but it would be really dumb to try on the multiple choice.

You have a million other things to concern yourself with and reporting something you thought you saw is not one of them. Catching suspected cheaters during the exam is the proctor's job, not mine or yours. In addition, snitches get stitches and it would not be worth the hassle, especially if there is a chance you could be wrong.

Re: Cheating on the bar exam
I don't understand why someone would want to cheat during the exam at all! You're willing to risk your professional future over a few points? It's just dumb. Worse comes to worse, you come back next session and rock it. I recall a woman in my state who kept writing after time was called and she was done for. No point in risking it.Cati wrote:I always wondered what stopped someone from hiding like a small review sheet in their pocket or bra and going to the bathroom (besides being a good ethical person?)

Re: Cheating on the bar exam
Yea I pretty much agree with this take. If you openly heard people discussing how they cheated, or saw someone in the bathroom looking shit up on their phone, that would be one thing. Thinking that you probably saw someone else looking at another's answer sheet that they wouldn't be able to cheat off of anyway . . . just let that go man.sprintin23 wrote:You have a million other things to concern yourself with and reporting something you thought you saw is not one of them. Pretty sure that when/where I took it you had to empty ulur pockets on entrance (admittedly that doesn’t address the bra issue).Cati wrote:I always wondered what stopped someone from hiding like a small review sheet in their pocket or bra and going to the bathroom (besides being a good ethical person?)

True each state has their own rules. But I have a lot of yoga pants / athletic wear and I know a lot athletic wear has inside hidden pockets.
It was just a thought I had when I took my own bathroom breaks lol. But really, you know what you know. And the chances, even if you did make a “cheat sheet”, that the sheet would address the issues, is slim.

It gets reported to C&F, and you'll probably never be an attorney.BarAttackIL wrote:What are the penalties for cheating on the bar exam? Anyone?
Don't ruin someone's life because you think you saw something.

Yeah, it’s probably possible, even if a bad idea that’s not really going to help!Cati wrote:nixy wrote:Pretty sure that when/where I took it you had to empty ulur pockets on entrance (admittedly that doesn’t address the bra issue).Cati wrote:I always wondered what stopped someone from hiding like a small review sheet in their pocket or bra and going to the bathroom (besides being a good ethical person?)

I mean to be fair just reporting them wouldn't ruin their life. No reason to take some random person's word at face value, you might just have a grudge against the guy. I'm sure there'd be a pretty in-depth investigation where they compared that person's answers to the people around them.
But that said just don't do it, doesn't really make sense.
