Mortgages was my trouble area too, I did as neil said and just tried to memorize what I thought were important rules cold so I could regurgitate them - I gave up on understanding them. Not necessarily helpful for the MBE per se (unless an element is missing, etc), but I think it is helpful for the MEE (though of course, you may not get tested on it).

Have had really lackluster responses from Themis re answers to substantive law questions so thought I'd ask this here: what is sufficient to constitute privity when it comes to collateral estoppel? The outline doesn't have a firm answer, and I just did the question about the chef being found negligent in a suit against his employer, but he is entitled to re-litigate the issue when he was subsequently sued because he constitutes a different party. Is an employee not in privity with his or her employer? I would post the question but TLS is prohibiting me b/c of copyright issues. It's in Mixed PQ set 3.

The 4 MBE mixed practice sets I've done: 68, 74, 74, 82. Two more coming up today. This is after I got a 51 on the Practice Exam #2.

Has anyone gotten locked out of a practice exam and had to contact them to re-open it? How long does that take?

Thanks for the responses. Also got me wondering how the averages on the Themis practice exams would translate to overall averages. Do yall think that average on a themis exam would be higher than average if taking into account everyone that takes the bar? My thinking is.. if themis has higher pass rates than the average bar taker (which their stats show) then average on their practice exam should theoretically be higher than average when compared to all bar takers.Molj1987 wrote:dabigchina wrote:The first one is really hard. Mixed Question Sets 1-4: 76; 88; 80; 78 - Thought the 4th one was pretty hard and that I did way worse on it than I actually did

It was based on the Milliken v. Bradley case. Consider this in terms of the background purpose behind collateral estoppel. It's a squishy rule, but if two parties have substantially different interests, they're not in privity. An employee and an employer aren't in privity because in torts/agency, they have substantially different liabilities. Mixed sets: 71%, 59%, 68%, 76%, 68%.
The 2nd set is an outlier b/c I accidentally chose interactive mode, rather than test mode. The 100 question test was so exhausting though, I definitely lost focus around 75 questions in so I'm sort of satisfied I didn't do worse than I thought lol.
