this might sound stupid but I noticed I "got it" quickly when I started imagining what goes on in the court room when each rules comes into play. I understood the rules but the problem was memorizing all the details.

The "what would Jack McCoy do" strategy has actually gotten me pretty far with evidence and crim pro.

Search the forums. There are some good evidence outlines on here.
I also think there is a sticky of "Tanacuiu's Guide to Bullshitting the Bar"

The questions are so granular. Maybe I should use the ones from Strategies&Tactics instead.

Question: In deciding preliminary questions, MUST the judge excuse the jury or it it discretionary?

I bombed the Evidence workshop. I really improved once I learned the impeachment and hearsay rules.

I didn't take Evidence in school so I was pretty nervous and focused on it early. I am somehow in the 92nd %tile for Evidence under Barbri's MBE questions. However, I'm in the 43rd %tile for Property - a class I CALI'd. It makes me wish I didn't take more of these classes.

I am banging my head for Evidence, too. But also because I need to learn these California distinctions plus rules that have no equivalent in FRE. I swear, I am going to misremember on test day, and write out a Cal rule when it's fed, and vice versa. :roll:
