I'm happy to share the full handouts if needed. The handouts are way better than the FROS

I've done the graded one, did more of a read and outline for another and I'll write out one more this week when I (finally) do the practice essay exam. Personally, I know I'll do fine on that and my time is better spent practicing essays and studying my state distinctions. I wish the whole exam was just a bunch of MPTs, but maybe that's just me. :)

I kinda wish the NCBE let us know our raw MBE scores immediately or like, within a week of the MBE. That'd be so doable, and it would relive me of so much anxiety I'll no doubt experience through October.

As I focus more on essay questions, I realize that if you have time left, it is worthwhile to read through the question again. Even though I'm good at hitting the major issues (at least when I've reviewed that topic recently!), there's usually some minor points in the facts that I glossed over.

dang that optional 100 question review in the book was the toughest set of questions I've had yet from Themis, based on the score explanations and answer distributions online it seems like that was by design though

My state director acknowledged that set is ridiculous

It was very hard. I barely scraped by the goal, did not expect to. A lot of the answers turned on very, very tiny nuances. [See my angry rant yesterday about disclaimers of implied warranties.]

FYI - My Themis director just called me and I asked for additional questions/practice essays. If you need additional questions, you can probably contact your state director and ask for them.

She was reluctant because she said I should be focusing on learning and memorizing the law at this point. She said I still have 400 questions left, but just counted them and I only have 186 questions left so I don't know what she was referring to. This makes me think that they will probably not give them out right away when you ask.

I'm in a UBE state so I'm guessing just MBE.

That's annoying. You learn a lot by doing essays. I remember an issue after dealing it with it on a question, and it helps you understand when you see the black letter law applied to a fact pattern

My Themis state director told us that if we wanted more practice essays, we could go do the ones from the "Law School Essentials: Upper Level" course from the Themis launch page. (Click on "Return to Account Summary" from the very top of the main bar page if you're logged in.) I have no idea if they're duplicates (I still have about a zillion essays left to do in the Themis bar course), and they don't cover all the MEE topics (like, they have Corps & Wills/Trusts but not Family Law & Sec Trans) but may be a resource for anyone who's run out of practice material.

Also, it makes me feel better about Themis making me go through that launch page every time I log in.

I know some states also have, on their bar page website, old versions of the exam. Might not be helpful for all states, but I know it is good for at least some states.

I have 4 mixed sets left and I'm at 2090 on Themis (with another 150-200 I've done through PMBR). Still not where I'd like to be % wise.

Yes, I've actually done the ones from MN because they're a UBE state and they have representative good answers. Haven't done all yet, but will probably finish this weekend. FWIW I started early and incorrectly overcompensated for some off days I was expecting to take to try to look at apartments, so that's why I'm so ahead and want more practice. I've done over 2100 questions so far. Still feel would like more practice. My overall score right now is 60% but on the recent sets, I've been averaging around high 60s-low 70s except one where I miraculously got an 80. I don't want to have to spend most of my day memorizing when I can actually be applying the rules I've memorized.

[+] Spoiler
A contractor purchased a furnace from a distributor of heating systems, after the distributor recommended the furnace based on the contractor’s stated needs. The bill of sale between the distributor and the contractor stated, “All warranties, express or implied, are hereby disclaimed.” The contractor installed the furnace in an office building. Due to a manufacturing defect, the furnace failed to heat the building as it should have. The contractor was sued by the owner of the office building.

Can the contractor assert a claim against the distributor for breach of the implied warranty of merchantability?

Answers:

No, because there is no implied warranty of merchantability for sales between merchants.
No, because the distributor disclaimed this warranty.
Yes, because furnace failed to heat the building.
Yes, because the contractor relied on the distributor’s judgment.
Rationale:

Answer choice C is correct. Goods that are not fit for the ordinary purpose for which such goods are used are not merchantable. As a merchant seller of the furnace, the distributor can be liable for breach of the warranty of merchantability. Answer choice A is incorrect because the implied warranty of merchantability applies when the seller is a merchant. It applies even where the buyer is also a merchant. Answer choice B is incorrect because a general disclaimer is not sufficient to disclaim the warranty of merchantability. Answer choice D is incorrect because reliance on a seller’s judgment is not a requirement of the implied warranty of merchantability, and a warranty of fitness for a particular purpose may be disclaimed in general language.

WTF, NCBE? They're asking SPECIFICALLY about the implied warranty, which CAN be disclaimed in a conspicuous writing. I still don't get why I was wrong.
THIS QUESTION IS ALSO A RADICAL ISLAMIC TERRORIST.
From now on, when I get MBE questions wrong, I'm gonna stand up and start shouting, "WE NEED TO FIGURE OUT WHAT'S GOING ON! THERE IS SOMETHING GOING ON, FOLKS!
Our answers to any equal protection questions on a Con Law essay is "THERE IS ONLY ONE AMERICA!" lol

2090 on Themis, 750 on AdaptiBar. So 2,840 total. Overkill? Probably. But I gotta say, I can see patterns in the questions a lot easier now than I did in Week 1.

Seriously? What are you waiting for?
