but isnt the exception that they can only search it IF the arrestee is unsecured or they think they'll find evidence of the crime for which he was arrested in the car? regardless, i picked that it was a search incident to lawful arrest

Yeah, that's what I'm talking about...and in the interim the department changed its policy, I guess I don't want to get too specific but that's the exact one. What an absolute joke of a question.

Yeah they can contest a seizure, not a search. That's one of the roughly 3 I know for a fact I got right lol

IIRC from my law school crim pro class (no thx to barbri), a prosecutor CANNOT renege on the deal, even if a new one comes in

Mine too, and I agree with that completely. But at the very beginning of that question, it was heavily emphasized that at the plea hearing the judge said "I do not have to go along with this recommended sentence..." and then we know what happened next. That's what I was saying, that question SHOULD have been easy for a number of reasons. Instead, after googling it, I still am not sure whether or not I got it right. Such a joke question...

Hold on. I thought the rule for searching the passenger compartment was that, once arrestee is secured, they can't search unless they have reason to believe evidence off the crime of arrest is inside? You can't just put the guy in the squad car and then search the car incident to arrest.
