Don't worry. Me too. I'm holding off on Session 3 so I can go through my wrong answers. It's so dumb b/c I got an A in ConLaw in law school but when you take the bar, that kind of thing is irrelevant.

All of these posts are so reassuring. Just when I think I'm the only one bombing, I check in and realize that so many of us are trying to push on through. I'm sure everyone got the email about the necessity of being at at least 40% by the end of tonight--not going to happen for me but I'm working on it. It's looking like I will be hitting that 40% mark tomorrow. Either way, I'm going to continue to approach this with a positive attitude. Have a good night all!

P.S. Evidence really does suck.

I did the evidence lectures. Didn't take evidence in law school. Don't have a grasp on it... (probably take two solid days of side-studying). Don't know why I took secured credit instead of evidence. Only at the 35% mark, and trying to get to 45% by Thursday. It's going to be a busy week. Did not find the Abraham Lincoln hypos in the lectures helpful.

Same here! I went from 80% on the first set, down to 40% on the second. Glad to know I'm not the only one struggling.

Am I the only one having an issue with the videos loading? This has been going on since last night.

Thank god for this guys zombie analogy for hearsay, otherwise I never would have understood how exceptions to a rule work.

You're not alone, that was abnormally hard. I went from 80s and 70s in the first three to a 53%.

Damn. I don't quite understand why my performance on the Milestone is lower than my performance on the PQ sets. I scored way below what I have been doing on the PQs, and I do both closed book under similar circumstances.

some of the questions on this second milestone were seriously "wtf" worthy.

I sent Themis an email. Hopefully it gets better. For now I'm using my cellphone & wi-fi. Sucks I can't up the speed but I guess it's for the best.

I really don't like it when the NCBE changes the language it uses in questions. I missed one about supplemental jurisdiction because the correct answer used the phrase "same case or controversy" instead of "same transaction or occurrence." Like, I knew that the court should have had supplemental jurisdiction, but I didn't choose that because I had never, ever seen them use that phrase before.

Of course, I missed it because they used "same case or controversy" to mean the same as "same transaction or occurrence." Literally every practice question uses the phrase "same transaction or occurrence" and I have never ONCE seen the phrase "case or controversy" used as a substitute, but of course the one relevant question on the Milestone does something different.

Also, literally just fucking laugh that the NCBE gives a question with fact pattern almost identical to a real case, but comes out the opposite of the actual case. The case was about the gender discrimination between mothers and fathers of illegitimate children.

Same! I also got exactly 20% lower on the Milestone than I did on the Mixed MBE set yesterday?

This happened to me - I believe on a con law question where language is SUPER IMPORTANT. I don't think I've gotten a single question right where they modified the language.

Jumping on the bashing bandwagon. I'm incredibly frustrated with Themis today. In my jurisdiction, there is a 4000 character limit for MEE. The sample answer had over 5100 characters! How am I supposed to fashion a good answer when the sample doesn't qualify??

Argh.

It's fucking frustrating to go from 65 to 70% on PQ sets and then drop 15 to 20% on the Milestone. I honestly just don't understand it. Now I'm mentally fucked and can't even concentrate on the stupid practice mpt or essay I'm supposed to do today

...holy shit.
I took the Feb MA bar and I believe "who owned the eggs" was on one of the essays. There was a TON of FL on Feb so maybe they will go lighter on it in July..

You're talking about that Nguyen v. INS question? Yeah I remembered that that was the case they were testing when I read the prompt. I thought that was such a deceptive question, because you KNOW they were trying to get you to think, "Oh yeah, this is the Nguyen case, didn't the dad lose in that? He did, and if go with that answer, you're wrong. After reading their explanation, I still don't wholly get how this fact pattern is different from Nguyen. I thought Congress could enact alienage laws like that so long as they weren't arbitrary, and wasn't that basically the holding in Nguyen? Someone can school me if I'm wrong.
I actually did surprisingly well on Milestone 2, although I thought I was failing badly during it. I guess my AdaptiBar/Critical Pass combo is paying off (not to sound like an infomercial), but jeez, I did not feel confident about those questions. I was positive about maybe 20% of those questions, iffy on like 50%, and straight up doubtful about the remaining 30%.

I'm glad I'm not the only one! 68 on MBE mixed set 4 yesterday, 56 on milestone exam 2 today!

FUCK.

Also annoying that the MBE and MEE milestones are only 0.3% each .
