What's the logic behind the vicious watchdog exception? I get the rule and all, it just seems stupid. Someone trespasses and your king cobra attacks them, no strict liability. But WAIT, you had an ORNERY TERRIER? Fuck you, pay up you goddamn psychopath.

I equate it to the prohibition regarding deadly force to protect property. The common law presumes that a vicious watchdog has one purpose - to keep people out by the use of dangerous force, and thus liability attaches.Easy-E wrote:What's the logic behind the vicious watchdog exception? Yuck. I thought Florida was fucking lame with Secured Transactions and Commercial Paper as testable essays. I can't even begin to fathom the thought of an evidence essay. Sounds absolutely dreadful.Easy-E wrote:Fuck that alligator question in torts PQs #4.

Themis had a graded Pennsylvania essay where one question turned on a critical exception in employment law (third party retaliation claims) that wasn't covered at all in either the lecture or the long outline. So there's that.Easy-E wrote:Fuck that alligator question in torts PQs #4.

I got around a 70 on the first set but lucked out by not getting any mortgage questions. I'm sure that will change as soon as those start popping up.ultimolugar wrote:I'm three deep myself. 60 is my average. Same. Mine was on an inmate and guard. Some evidence essays have def been harder, but I'll take evidence over property or Ks any day.Chardee_MacDennis wrote:I thought the evidence essay was relatively straightforward. I can see some light. Finishing up MBE Crim Law + MBE Crim Pro lectures this weekend. Finally, will be done with lectures on MBE subjects.
Hang in there, we all gonna make it.

Struggling with MBE Evidence lectures. Guy barely follows the script and I can't seem to follow him at anything past 2.0x.

Re: Themis Bar Review Hangout - July 2016
I watch all the vids at 2.0x w/captions and pause as necessary, but I watched Evidence at 1.5x, just bc of the sheer volume of information. It was too hard to wrap my head around all the rules and exceptions at high speed. I had a great evidence professor as well, so it was mostly review, but even still, 2.0x was just too fast for me personally.Easy-E wrote:Struggling with MBE Evidence lectures. Yeah, the explanations are worded like, "under the exception you should know but we never told you about..."
Pissed me off.
