Anyone think Mixed Set 6 was a little tougher than the rest of the mixed sets?

Exam Tip
The Necessary and Proper Clause standing alone cannot support federal law. It must work in conjunction with another federal power. Thus, an answer choice that states that a law is supported by the Necessary and Proper Clause (or is valid under Congress's power to enact legislation necessary and proper) will be incorrect unless another federal power is linked to it in the question.

Actual MBE Question:

The federal government has complete jurisdiction over certain park land located within the state. To conserve the wildlife that inhabits that land, the federal government enacts a statute forbidding all hunting of animals in the federal park. That statute also forbids the hunting of animals that have left the federal park and have entered the state.

A hunter has a hunting license from the state authorizing him to hunt deer anywhere in the state. On land within the state located adjacent to the federal park, the hunter shoots a deer he knows has recently left the federal land.

The hunter is prosecuted for violating the federal hunting law. The strongest ground supporting the constitutionality of the federal law forbidding the hunting of wild animals that wander off federal property is that

A. this law is a necessary and proper means of protecting United States property.

B. the animals are moving in the stream of interstate commerce.
C. the police powers of the federal government encompass protection of wild animals.
D. shooting wild animals is a privilege, not a right.

A is the correct answer. Article IV, §3 gives Congress the power to make regulations regarding territory or property belonging to the United States. Therefore, Congress can protect wildlife that crosses onto federal land. See Kleppe v. New Mexico, 426 U.S. 529 (1976). Answer B is incorrect because there is no indication that the animals are involved in interstate commerce in any meaningful way. Answer C is incorrect because any federal police-type power is only exercisable pursuant to the property power, and thus only applies to wild animals that cross into federally owned lands. Answer D is incorrect because it does not explain the constitutional basis of the power under which Congress may enact this law, which is the inquiry.
The authority comes from federal property power which gives congress authority to legislate federal property as they see fit, and they do so through the N&P clause. So the N&P clause is not standing alone here. Good luck!!

Oregon, land of the 284 minimum passing score. :-/ WISH I was taking it in Illinois, except then I'd be in Illinois and wanting to kill myself.

Jersey here too. Sitting in Somerset.

I memorized all of the lecture outlines to the best of my ability, spending my last days reading property lecture from front to back because to me property is just a different language and I hate it.

Dude, you legit need to chill with the IL hate. There is no reason to bring that up, and you're constantly shitting on the state randomly all over FB. It's cool if you don't like a state, but you don't live there anymore and there's no need to blatantly shit on it in a context like this, where it's totally uncalled for. You go out of your way to say something, anything, awful about it, and I just don't see the point.

I know I've been guilty of hating on IL in the past because I was really quite miserable there, so I scrolled through my facebook to see if Crumps had a point. I've mentioned Chicago or Illinois three times since the beginning of Oct (where I got bored of scrolling).
1) Complaint about how hard to read IL criminal records in the national LEDS system are, because they are, and it was making my workday harder than it had to be--the states use various formats, all annoying, but IL's is particularly terrible.
2) Joke about how I always want to poke cops in their bulletproof vests, except maybe not Chicago cops.
3) Mentioning I own the Chicago Starbucks 'you are here' series mug as part of my modest collection.
4) Posting a pic of the dinosaur skeleton outside the Field Museum wearing a Cubs jersey because I thought it was cute.

I will, however, rephrase my original post and say that I'm extremely worried about failing (again), and I wish Oregon's minimum passing score were, say, 20 points lower.

I'm at like 72%-ish on Adaptibar questions recently, which I don't think is high enough to make up for my COMPLETE AND UTTER SUCKITUDE at essays.

I am focusing on PT the rest of today and what I can manage to do tomorrow (i have to drive 3 hours to my hotel). I feel that's the most valuable use of my time since I already spent too much tome on MBE imho (2450 questions), and there's not a lot of memorization required for PT.

Is MBE weighted 50% in Oregon, or less?

50%. Wish it were more, honestly! I am REALLY bad at issue-spotters, as my crappy 1L grades showed. Never been able to improve it much. Like, I'm thrilled at a 3 out of 6 on an essay.

I would not say I have been strong at all anywhere but I am doing 50% worse now. I pick an answer, then think, oh, but if... But I chose an answer like that on a similar question, and I was wrong, so I change it again.
