it could only be assault. for intentional torts the "intent" simply needs to be voluntary. also if i remember your hypo correctly it was for NIED, which needs damages, which according to your hypo is absent.

The Supremacy Clause of the United States Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the supreme law of the land.
