I'm handwriting the MEE outlines from efficientbarprep which are pretty much short versions of the Barbri lecture notes (almost verbatim) Really helpful so far.

Woohoo! I just spent the day going over past essays and answers from the NCBE. And finding that some of the answers are different than what Barbri writes. I'm just sticking to those from now on. The answers are simpler and much more realistic to what we can do in half hour

Is it too ballsy to punt Secured Transactions? It was tested in Feb and hasn't been tested back to back in years.

Idk dude, like, you can probably get a basic enough grasp of the rules to bullshit it okay in like 30 minutes or so, so prob at least do that.

So the lecture handout book has three essays from last summer, and three from last winter, and we were just supposed to do the summer ones today?

Am I the only one that didn't think these essays were simple? I thought con law was fine, but

for contracts I had forgotten about the performance exception to statute of frauds (though I actually considered it since I remembered part performance for property exception). Also, I spotted the handwriting and letterhead issues and thought about confirmatory memos, but was considering only the UCC acceptance rules for added terms rather than confirmatory memos. I knew I was missing something since I had like 15 mins left over, but I didn't know what to write.
Secured transactions was just LOL because I don't know that material yet.

Also, the MPT seemed fine as I was reading through, but then I just kind of got time constrained as I was wading through all the different standards of negligence and duties. I feel like I always have a million thoughts running through my head on the MPTs, and have trouble organizing them into a coherent, well-organized answer. I end up getting most arguments but sometimes just throw them on the page in an illogical order because I can't figure out the right framework in the short time. Anyone else have this problem or know of a solution?

Can someone explain this point on today's contracts essay?

In Barbri's answer, I'm not seeing how they figure that if the chef signed his first note, he would have bound the manufacturer to send him 10 knives. Wouldn't the chef's signed note/ confirmatory memo have come into conflict with the manufacturer's writing, setting up a 2-207 situation where the quantity term gets knocked out? (Not exactly sure what happens then, but I think you can find a contract implied by conduct, which would just be the shipment of the 6 knives?)

Obviously way overthought this during the essay, but is this wrong? I'm pretty sure conflicting confirmations are subject to 2-207.

My biggest concern with guessing is that Feb was the first (second?) time that Civ Pro wasn't automatic. So now there might consistently be 4 MEE topics tested, as Civ Pro likely won't be tested on MEE for awhile, but who knows. Just no way of guessing because the sample is now damaged by the removal of Civ Pro as automatic. :(

Also - are there scoring guides for today's essays? I've looked but haven't found any. Would like a way to gauge how I did other than just the 9 minute video that sort of goes over the main issues.

Serious question - is there still value to completing the Barbri sets numbered 5 and beyond? It seems like they're getting a bit out of hand, and some of the questions seem to turn on points so narrow I'm wondering if they have value.

My bar mentor said sets 5 and 6 are ridiculous. She recommends just doing 1-4 and then doing questions from strategies and tactics, or other questions like that because they're much more realistic. I stopped doing sets 5 & 6

I've actually found sets 5 and 6 to be helpful and have been doing better on them than earlier sets. I make sure to review the subject with critical pass cards immediately before starting the set, and that sort of helps me crystallize the information in my mind.

I weirdly was only barely scoring above the set goals earlier on (usually getting 1-2 points above the goals), but I've been getting 13-15 on set 5's. Maybe give that pre-set review a try?

Agreed. Although some of them are rather difficult (a few Set 5s stick out in my mind), overall they're not unfair or anything and are still probably worth doing. My thinking is take on the challenge now, learn a few things, and hopefully in comparison some of the real MBE questions won't seem as daunting.
