I'm glad that MBE question bugged me enough that I read my real property outline to find the answer before the essays.1swift wrote:no clue on variance but I picked up non conforming use in the MBE. Congrats on the bar exam being done... I had a question to ask all of you.
I was thinking about taking the Cali bar but didn't want to spend a ton of money on a bar review course. This would be my second bar that I am sitting for.
Does anyone know a place where I can get cheap/but very good outlines? I know there are some websites like ebay! Wanted to get your opinion first.

Ugh.. so i felt pretty confident about the exam. And the more I think about it the less good I feel.
But then I think about how close I was to passing last time when I had literally zero fucking idea of what I was doing...
This is a 2 month mind-fuck. Then you take the exam. Then you get another 2 month mind fuck waiting for results.
Some dick made a joke to me about it being "cruel and unusual punishment" and the only way i could respond was "actually the 8th amendment...."
Fuck me.
I wish that whole memory-erasing technology was a real thing.

That's usually a good sign. The more you know, the more you're aware how weak you are, which means you probably did better since you know more. I'm pretty sure i did better than July (which i bombed hard even though i felt ok about it), but I'm figuratively praying (A1 issue anyone?) I was minimally competent enough to pass.
I too keep thinking of more things i could have talked about, but they understand the time pressure, right?

Relatedly... is this graded on a curve like school? Or is it the kind of thing from undergrad where you earn X points and you're a winner? I never bothered to figure that out.

I felt bad for a minute for the asshole that has to read my second PT. Honestly. It was straight up garbage. I'm hoping they just look at the format and go "Oh she clearly got it. A+++."

I think it's a combo of points and curve. The raw points are adjusted to a scaled score according to how difficult it was, which is probably gauged by other people's performance. I don't know whether they decided they want to pass ~65% in July and a few dozen in Feb, but the curve probably isn't that significant in the sense that every year people will perform approximately that well regardless because of the law-school makeup in CA. And then you have to meet the 1440 threshold for the scaled score.

Haha what else is there to do? That's probably my best work considering I can only draw stick figures. Getting a much-needed haircut soon so I don't look like a yeti. Getting a drink with friend later. Playing ESO Beta over the weekend. Prep for an interview on Tuesday.
And in PT-B...were there pieces of evidence to be considered separately? The trial transcript Defendants wanted to exclude had a couple recanting statements that were subject to exclusion (that Rock didn't shoot the victim or that Rock didn't have the gun). I just clumped everything together. What pieces of evidence did you guys talk about?
