PSA: there seem to be way more New York choice of law analysis questions on essays than barbri lets on in the table of contents. They call them "federal procedure" topics as you use Erie to decide that the federal court should use NY choice of law, but then of course you do the NY choice of law analysis that the sample answers (rightfully) do

Every choice of law question was really simple, the only exception tested being that you use where the insurance contract was created for those claims

Speaking of which, how much time have people spent studying Federal Jurisdiction, Conflict of Laws and Secured Transactions? Has anyone seen anything beyond the obvious covered in essays?

Ha I spent all day studying those and then when I looked at essays I was thoroughly pissed off at how only the most basic of shit was tested

Most difficult part of secured transactions is actually determining that that is the issue tested, because sometimes I'll just go on an irrelevant contracts or property rant instead for zero points

Other than difficulty, I could not tell a difference between Barbri questions and the real ones. They "felt" the same. I actually thought they felt more similar than the questions from strategies and tactics, which I think were a little outdated.

Are the Barbri mixed sets real questions? I thought I vaguely remembered that being the case. at any rate I did about the same on the real thing as aggregating how I did on all of the 50q mixed sets.

However, I will say I can't remember a single easy question and only remember the hard ones. This is why you'll think you failed afterwards. I'm sure there were a ton of easy ones, but I only could focus on the high number of "unsures" that I was accumulating. This is normal.

Yes! I've been surprised as I've been reading the essays how frequently choice of law comes up, but isn't listed as one of the topics. I groan a tiny bit every time I see "State X." Agreed though that its always very very simple, either neumier/torts or insurance. As far as I can recall, its only been choice of law issues, I haven't seen any recognition of judgment at all.

Here is to hoping that if they show up in the essays, it is only one of them! There is just too much stuff for my brain to get all of this crap under my belt.

What is everyone's approach to NY Practice? It's such an insane amount of detailed information. Are you just memorizing the major topics for essays and gambling on multiple choice?

memorizing HIGH priority for NYP and some of the SOLs. NYP comes up in some other topics so i'm looking at the crossovers. and that's about it. i just can't deal with all that little stuff.

Yeah I'm gonna do all of the statutes of limitation (there's not many actually and it WILL be on one or two essays as a sub topic), provisional remedies, the standards of review for failure to state a cause of condition, summary judgment and motion to dismiss

Also, when was the last time Federal Civil Procedure was on the exam?

Kind of seems like the NY Bar Examiners really have narrowed the field down to Wills, Family Law, Corporations, CPLR, PR and Trusts from just the purely NY topics.

i didn't watch the part of the wills lecture on RAP. would it be a HUGE gamble to not listen to it at this point considering it was just tested in the winter and apparently comes up every 10 years? i know no one knows what will be on this exam, but have folks been studying that part of the lecture intently/was it too difficult in the first instance to even be worth me trying to understand the concept this late in the game?

i just have to much else to cover...just wondering what people who have heard that part of the lecture think...
