The average was apparently a 2, but I think tons of people, myself included, got a score of 1. I'm sure our essay scores will increase by at least a point on the second time around even if we don't actually do anything to improve them. Just watch.

"A wife owned a pistol, which she kept loaded in a locked safe in her bedroom. Unbeknownst to the wife, her husband took the pistol, fired it at a pesky squirrel until it was empty, and returned the empty pistol to the safe. Shortly thereafter, the wife returned home to find her husband and sister alone in the house. The wife, having long harbored jealousy over the close relationship between her husband and sister, decided to teach them a lesson. She got the pistol, pointed it at her husband and sister, and threatened to shoot them. She never intended to shoot them, but merely to scare them. The husband and sister have sued the wife for assault. Is either the husband or sister likely to prevail in an action for assault?


A. No, neither will prevail because the wife did not intend to shoot either the sister or husband.
B. No, neither will prevail because the pistol was unloaded.
C. Yes, the sister alone will prevail because she did not know the pistol was unloaded.
D. Yes, both plaintiffs will prevail because they can each prove the elements for assault."

I picked D, foolishly under the impression that the question author was aware of how stupid it would be to calmly assume a firearm pointed at your body was unloaded just because you recently used it and know it was unloaded earlier. The correct answer is, of course, C. Thanks, MBE writers. Of course a reasonable person assumes a gun pointed at them is unloaded just because they recently think they unloaded it. And there is absolutely no way the wife could have, like, loaded it again.

I just finished NY's Professional Responsibility lectures. Yocham was pretty funny. His "throw the wife in the woodchipper" and "sleep with the entire" firm jokes were especially funny.

Just discovered that you can view the "national average" for MBE practice sets. So that was a nice kick in the nuts.

Huh. Mine show National Average of 62% for Contracts and 65% for Torts.

It's still early. Expect your numbers to improve the closer you get to test day. Just make sure to stay above Themis' recommended average (this is 50% at the start and then, I expect, will ramp up).

Mine says an average of 44?
My essay averages is 26. It must be the average of the essays your personal grader has graded.

I'm about as far along as you are and I didn't get a call... I think the frequency and timing of calls will vary from rep to rep - just like the essays have been graded differently from grader to grader... I'm sure you're ok!

How'd everyone do on the MileStone? I just took mine, not feeling too great about it, but saw clearly where the fatigue set in (after question 28). Ended up with 64%.

Also got hit hard by fatigue. I kept kicking myself because sometimes I would get the answer right but would bubble the wrong answer, click "next question," and realize in horror that the testing software would not allow me to go back and change it. This happened to me several times near the end.

Depends on when they started the course. My milestone isn't scheduled until next week. So I have 7 days to stop sucking.
