So is a target score on a Barbri set supposed to predict a national median score on real things?

Actually, now I question what I do have..I looked at mini review and big outline and about all I can come up with is Insufficient warning=design defect and that there is a presumption the warning label was read by consumer. I know it came up in a neg case though in a practice question (may have been adaptibar) and I should have wrote down the explanatory answer but didn't.MrMustache wrote:Could you post what you found? On the outset, there are three categories of "defects" under products liability: a Manufacturing Defect, Design Defect, and Inadequate Warning. I think where you're getting mixed up is that a Design Defect is different from an Inadequate Warning. I think y'all are getting too hung up on SL product liability. I don't remember any questions about it on the July MBE, but maybe there were one or two. Certainly not enough to warrant learning the entire subject. Usually the products questions specify a negligence claim.

Just that basic stuff, that everyone else but me has probably already memorized, like Personal Jurisdiction template on page 4 of Civ Pro essays section. Talk about PJ in general, then discuss Long arm statute, then discuss constitutional limitations (minimum contacts, purposeful availment, foreseeability,), then relatedness of claim to contact, specific jurisdiction, general jurisdiction, fairness, convenience, state's interest, other factors.gtg wrote:Which templates are you referring to?MrMustache wrote:I'm starting to have major freak-outs about essays. I look at it and I know/understand all of these things. But when it comes to recreating this little list, I keep missing an issue here and there.

CA's MBE Refresher is scheduled for today. Wondering if I should complete it or instead opt to do one of the 100 question sets at the end of the Emanuel book made up of past MBE questions. I know the Barbri refresher is supposed to be more challenging (and therefore helpful?) but I also have heard that it shatters confidence. On the other hand I could get destroyed by the real questions and then my confidence would be shattered either way. What say you, tls?

I did okay on the July MBE, and my current knowledge of MBE subjects is far better than it was last year. I did all of BarBri's questions + 1,300 through my school's supplemental program, which consisted of 3 and a half mock bars + review of the 3 full mock bars.
At some point, it gets to be overkill, but once you do a ton of them, you really start to see the patterns that come up again and again.

According to BarBri, I did 366 practice questions and will do another 100 on refresher today. Will probably get to around 500 by test day. Woohoo.

Ive done 1069 according to Barbri and another 500 on my own. Planning on finishing the MBE refresher today and then try to get through about another 100 of real MBEs over the next 5 days. That would put me between 1700-1800.

It's about being smart with your MBE prep not just doing as many questions as possible.
Last time (July), I did over 2200 questions and still just did mediocre on the MBE. This time, I've done significantly less but I feel I've studied way way way smarter. I have much higher expectations this time around.

I think on the homepage (the one that has a background and a quote that changes everyday), you can cycle through that information on the left. Could someone please explain Governmental Immunity to me (in general and particularly in Torts)? I know that the Gov't needs to "give permission to be sued." But I remember from doing the essays, that there was a question about someone calling 911 and the cops going to the wrong address and that person suffered an injury and sued the gov't, but the Gov't Immunity applied. In a different question, a state employee injured someone and they did not mention Gov't Immunity. Thanks.

Can you recall which essay the police question came from? I remember it clearly -- someone called the cops because a friend was outside ready to beat him up, the cops went to the wrong address. If I recall correctly that question tested the 1 year and 90 day rule, and the plaintiff failed to give adequate notice within 90 days.
