Guys this is depressing. I'm getting off this thing for the night. GOOD LUCK tomorrow everyone. I'll keep my fingers crossed we don't have any Softest issues, and no one faints or yells or anything absurd. I'm afraid I can't do anything about the constant train noises in Ontario. We'll just have to deal with those.

You mean Duties? He has the implied warrant of habitability, the duty to repair (if a residential tenant), and a covenant of quiet enjoyment. These are the major ones.

all other covenants that run with the land --> look to the original parties' intent to have that covenant run with the land (show: intent + touch & concern)

I think everything mentioned is right plus duty to avoid waste. Warranty of habitability is also residential.

Anyone want to help eachother at this late hour? What are the most likely tests to come up tomorrow for each of the five likely MBE subjects (I am betting against Contracts, and not counting out Corporations if another CA topic arises):

I'll go first.

Conlaw:
14th amendent (not coming up, tested last time),
Speech, Religion-- IMO most likely.
State Taxation and Regulation of Commerce, including the comity clause.
Justiciability
Executive Action/Limitations on Powers
Then the random ones that they can throw in for a quick analysis: Preemption, Takings, Prohbitied Legislation.

I posted my high-level predictions a few hrs ago. Hard to say exactly which topics, but i keep coming back to ll-t stuff for some reason.

Too tired to look up the wording for a sublease where LL and T are in privity of estate and K.

I realized I miss a few easy MBEs as I was going through my outlines. I can clearly remember the 50/50 answer choices and me picking C over B when the law clearly points to B. No thanks to my brain which doesn't even have photographic memory when I need it.
