Guys this is depressing. I'm getting off this thing for the night. GOOD LUCK tomorrow everyone. I'll keep my fingers crossed we don't have any Softest issues, and no one faints or yells or anything absurd. I'm afraid I can't do anything about the constant train noises in Ontario. We'll just have to deal with those.
See you on the other side...

Can someone remind me what covenants a tenant has when he leases from landlord?

You mean Duties? He has the implied warrant of habitability, the duty to repair (if a residential tenant), and a covenant of quiet enjoyment. These are the major ones.a male human wrote:Can someone remind me what covenants a tenant has when he leases from landlord?

I saw someone have a complete breakdown in Oakland today. Waterworks and all. I felt so so horrible for them.

a covenant that runs with the land always be renta male human wrote:Can someone remind me what covenants a tenant has when he leases from landlord?
all other covenants that run with the land --> look to the original parties' intent to have that covenant run with the land (show: intent + touch & concern)

I think everything mentioned is right plus duty to avoid waste. Warranty of habitability is also residential.
I posted my high-level predictions a few hrs ago. Hard to say exactly which topics, but i keep coming back to ll-t stuff for some reason.Hoggle wrote:Anyone want to help eachother at this late hour? What are the most likely tests to come up tomorrow for each of the five likely MBE subjects (I am betting against Contracts, and not counting out Corporations if another CA topic arises):
I'll go first.
Conlaw:
14th amendent (not coming up, tested last time),
Speech, Religion-- IMO most likely.
State Taxation and Regulation of Commerce, including the comity clause.
Justiciability
Executive Action/Limitations on Powers
Then the random ones that they can throw in for a quick analysis: Preemption, Takings, Prohbitied Legislation.
Anyone else?

A LL and tenant who are in privity of estate which each other via the valid execution of the former tenant's lease assignment are liable to each other for all covenants that run with the land.a male human wrote:Can someone remind me what covenants a tenant has when he leases from landlord?
Too tired to look up the wording for a sublease where LL and T are in privity of estate and K.

What if a film crew dressed up like paramedics, followed the paramedics into some poor dude's house, and surreptitiously filmed said dude's wife die as well as dude's reaction to it? I think I would have to take a bathroom break to lol a little bit.

Man there was one MBE where I thought one of the answer's gonna involve UVPRA. Doctrine of equitable conversion and some other stuff I didn't expect showed up instead.

Quiet. Just checking to see if I missed anything good. NOPE. I reviewed most of my outlines. Saved a couple for tomorrow morning. GOOD MORNING
I passed out at like 8 after attempting to study. My body just rejected it.

but to balance it out the girl in front of me has a fantastic ass. I'm seriously considering asking her out after the exam is done.1swift wrote:You're in Oakland too? The woman in front of me had a little black thong on the body of a hippo. I can see her but crack through the space between the back support of her chair and the seat. I should ask the proctor for a new seat "excuse me ma'am, could I move? Her giant coin slot is too distracting for me."

I'm going to attempt to draw a comic about the tale of two asses later (what else to do with my spare time besides prepare for July)
I realized I miss a few easy MBEs as I was going through my outlines. I can clearly remember the 50/50 answer choices and me picking C over B when the law clearly points to B. No thanks to my brain which doesn't even have photographic memory when I need it.
