For those using real MBE questions: I've heard they're shorter and more direct (/test only one thing at a time) than Barbri's practice questions. Are you all finding that to be the case?

Re: Barbri paced program question?
I'm hitting a wall anywhere between 8 and 10 hours a day. I always feel the pressure to skim a state outline at night (which I have done on a few days), but most of the time I just quit for the day. I feel pretty comfortable with that decision considering I've only taken 1.5 days off since my Barbri course started in May. Plus, if you're not going to retain anything, it doesn't really make sense to keep going on IMO.mvpforme wrote:How many hours is normal to be throwing at bar review atm? Today I watched all the review videos for the simulated final exam, which my state had earlier this week. That was 7 hours of video, which I watched on 2x, but I stopped every few minutes to take notes and research issues. All in all it took 10 or so hours. Now I'm just brain dead. I feel like I should review a state subject or something before bed, but I just don't have the energy.

Wait . . so they allow bottled water through the door but not small 5-hour energy drinks? Whats stopping someone from pouring the 5-hour energy drink into a bottle of water?encore1101 wrote:jd20132013 wrote:has anyone thought about what they are going to do for caffeine?
i dont know if it varies by state but we can't bring in any five hour energies, etc or even a caffeine pill
I thought about taking an extended release caffeine pill in the morning? Idk though. I just dont want to be flagging at the end of the morning/afternoon sessions...
I was going to pour one or two red bulls into a one liter bottle, and mix the rest with water. It'll probably taste like ass, but at least I can drink it throughout the day.
Can I have peppermints in my pocket?

I assume his state's rules are different than mine. I can't have either.LAWYER2 wrote:Wait . . so they allow bottled water through the door but not small 5-hour energy drinks? Re: Barbri paced program question?
I find that they are generally shorter (exception being property) and somewhat easier. The only difference being that I think Barbri tends to tailor their answer choices to the exact wording in the CMR/lecture, whereas the MBE answers can very somewhat. That said, I got violated by a contracts MBE quiz last night, and it's usually one of my better subjects, so what do I know.beachbum wrote:For those using real MBE questions: I've heard they're shorter and more direct (/test only one thing at a time) than Barbri's practice questions. Probs. I'm taking it in NY (http://www.nybarexam.org/Docs/secpolicy.pdf), so we're allowed "One 1-liter beverage in a re-sealable, clear plastic container."jd20132013 wrote:I assume his state's rules are different than mine. I can't have either.LAWYER2 wrote:

Rules don't say that it has to be water, or that it has to be full, so I could theoretically just pour as many 5-hour energy drinks as I want, but I also don't want to be dehydrated from too much caffeine.

Re: Barbri paced program question?
How much do your written, state-specific essay question outlines conform to the sample answers? How much is good/passing?
For me, the Texas essay model answers are magnificently detailed and include tons of info, some of which goes beyond the scope of the Conviser outline. I can't match this stuff... not even close.
For example: When I compare my self-generated outline to the model answer, the typical outcome would be:
(1) for 50% of the questions, I get the legal conclusion right, and my reasoning broadly resembles in some or most aspects the correct rule of law, but isn't spot on in the specifics (for example, in custody/access contest by non-parent, recognizing that non-parents must overcome a very high burden to get a right of access (Troxel), but not remembering that Texas ONLY allows grandparents to contest access... or, in another example, mis-remembering that 6 months of parental abandonment + Best Interests allows a non-parent to win custody, when the real rule is 12 months + Best interests). Surely this must get Some partial credit?
(2) for 50% of the questions, I get the conclusion right, and my reasoning almost perfectly parallels the correct rule of law, but might miss some smaller details (e.g. noting that personal injury awards are presumed community property unless rebutted by breaking out the components of the award in the judgment... without mentioning up front the generalized presumption that all assets accrued in marriage are community property).
Is this good or bad? How perfect must answers be to pass?

Question-- what exactly is a "physical symptom" in regards to negligent infliction of emotional distress?

I don't know if I'm missing something but Wills is just far too detailed for a state to seriously expect us to be able to write an essay closed book...

Looked at some essays yesterday and all went well until I did the Trusts Essay #3. I was literally like well shit. I am finding that these Trust essays are above and beyond what the Barbri lecture taught. Anyone else feel the same way? I really do not want to see a Trusts essay on the Exam.

Re: Barbri paced program question?
Two silly questions:
1-What is the best time efficient approach to hand mbe questions? You mark them in the book, then copy/mark the bubble at the end, or mark them one by one?
2-I forgot.

I love the "How should Mrs Smith structure her trust?" type questions b/c I went to law school to become a fucking financial advisor. If I get this question in 2 weeks, I'm going to say 1) however she wants and 2) then sue her lawyer for malpractice.jaydizzle wrote:Looked at some essays yesterday and all went well until I did the Trusts Essay #3. Thank the lord it is not just me. Granted, I have not looked at trusts in a long time. I still feel this was an impossible question regardless.homestyle28 wrote:I love the "How should Mrs Smith structure her trust?" type questions b/c I went to law school to become a fucking financial advisor. Re: Barbri paced program question?
I remember learning during LSAT prep that it's more efficient to mark answers in the book, then transfer them at the end. Otherwise you spend a split second looking back and forth from the question to the answer sheet, figuring out where you were. Just make sure you have enough time to bubble at the end or you're screwed. The Egyptian wrote:Two silly questions:

on a side note, NIED can be established even if P didn't personally see the incident but HEARD it or perceived it with any other senses! That's a new one to me, (just got that mbe question wrong in studysmart).

Let us post obscure Nuances that weren't readily ascertainable.
For instance: In most Jurisdictions, strict liability will be imposed on developers of tract housing if any injury results from an unreasonably dangerous defect in a house they constructed. (exception where builder only builds single home)

Wow. If you're studying that much, you shouldn't be worry about anything. I have to think that amount is way above average.LouEVille wrote:I'm hitting a wall anywhere between 8 and 10 hours a day. Can someone repost that one page summary of commercial paper that was posted in one of the many topics floating around? looked around for a bit but couldnt find it
EDIT: Wait, just looked at my Barbri frequency chart and I don't see Commercial Paper as a topic my state tests...what am I missing? surely they wouldn't assign a subject that doesn't get tested?
