Don't intend to derail what is already a "productive" thread by TLS standards, but aside from the screaming about lawsuits and class actions (and contrary to some posters in here, I do think it was a big deal that this happened...the bar exam gives even the most rational person the crazies, and I can't even imagine going through something like this during the actual exam), has there been any explanation/investigation into why this happened? Cause I sure as hell do not want a repeat when I take it next summer.

Whomever fails the bar could successfully hold Examsoft responsible. Granted they will have to show how they were damaged by Examsoft (given the circumstances, not a high bar).
20,000 exam takers paying $150 = $3M. Examsoft could easily see that figure vanish in a heartbeat. It should get interesting around September/October. I wonder what firm represents Examsoft? They are going to need to hire more lawyers!

If you failed the bar because Examsoft didn't upload your answers, sure. If Examsoft uploaded your answers and you failed, you're SOL. (If you're going to argue that you failed the bar because the stress not being able to timely upload your essays meant you choked on the MBE: just no.)

It really was not necessary for most exam takers to IMMEDIATELY try to upload their exams. Having used the internet once or twice, I figured that systems would be bogged down and never even considered uploading the first day. If your deadline was 26 hours away and you didn't need to hop on a plane immediately after the exam, you could have waited. People can't reasonably believe that the board of examiners would just say "fuck it! no one gets to upload if you missed the deadline because the systems were down!"

I don't really care about the $150 or the stress (you do realize that everyone experienced this stress equally, other than handwriters). I do hope a few states/scools drop ExamSoft for being so incompetent. How do you not prepare for a large volume of data when you know exactly how many people will be uploading at a given time? This is a "you had one job" kinda situation.
Communicate now with those who not only know what a legal education is, but can offer you worthy advice and commentary as you complete the three most educational, yet challenging years of your law related post graduate life.
