Before I do a set of PQs or practice essays (especially for topics a couple of subjects removed from my most recent one) I go through my outline and Critical Pass flashcards and then try to do the sets and essays without looking. Is anyone else viewing the MPT workshop this weekend? I watched chapters 1-3. Did you actually complete the sample MPT before watching the rest of the chapters or just read through the documents? I'm a little confused which they expect.

I have a state-specific Performance Test, but the way it worked was that Ch. 1-2 were substantive videos about the performance test, with directions to complete the sample test as directed before going on to Ch. 3, which was just a review of the sample.Vantwins wrote:Is anyone else viewing the MPT workshop this weekend? Thanks, I'm in MD. Chapters 1-3 were tips on taking the MPT. Chapter 4+5 are about a sample MPT, chapter 6 is about another MPT, and then my course schedule also separately says I should do an practice MPT today. But at 90 minutes each, I'm hoping they don't really think I'll do 3 in one day?? I guess I'll just read through the samples for the lectures. edited to add that there are 18 practice MPTs, so no danger of running out.

Does anybody else have trouble with understanding the difference between levels of negligence (gross, ordinary, slight) or standards of proof (preponderance, beyond a reasonable doubt, etc.)? Themis uses the words, but does not define them.
I do not remember any law professors actually spelling out the differences. One drew a pie chart once to try and explain the proofs.

slight negligence = event a minor breach of duty will be sufficient
ordinary negligence = textbook definition
gross negligence = willful, wanton conduct, reckless disregard for the consequences of one's actions etc
preponderance of the evidence = more likely than not (i.e. 51% likely is proof enough)
beyond a reasonable doubt = not enough for it to be possible, or probable, you need to prove beyond any reasonable doubt (hard to put a percentage, but it would be a high one!)
Not sure if that's helpful at all - or maybe we need to have a more formal/ comprehensive knowledge for the exam (in which case, as you can see, i don't!)

Themis has me scheduled for 3 subject reviews today. I'm glad I finally have a serious block of time to dig into subjects. Also an easy day, I was studying for 8 hours saturday and sunday and my brain was starting to melt.

Common law criminal law questions are kind of infuriating, because it is an acknowledge fact that they are inapplicable and many are unintuitive. I keep missing questions because I forget that the common law rule for some of these crimes or defenses are so contrary to present criminal law, which is my fault but still annoying

Did the milestone multiple choice earlier - didn't put much stock by what the guy said in the pre-video about people getting bunches of questions wrong consecutively etc but actually, that does seem to have been what happened me! I'd get loads right, then five wrong in a row, and this repeated a few times throughout the test. Going to do the essays this evening - joy!

Just finished mine as well. Only got about half of the Property questions. Apparently I STILL don't understand mortgages.
