Why is commercial paper so hard for me to write about?
It's like I know the rules but it's weirdly difficult for me to construct an actual answer. Like, what do I put where, and how do I order things???
It's super freaking me out because usually the essay section is my strong suit. BLAH.

Does anyone know whether a passenger has standing to contest a search of a vehicle or items in the vehicle or her purse?

3) Probably no, but it depends. (See Houghton, which allowed the search to stand, but recognized that the passenger may have a privacy interest in the object beyond the driver's privacy interest in the car; but still a reduced privacy interest because of the automotive context). Because it depends, it's unlikely to be tested on the Bar.

Most likely "no" to all 3 questions.
However, a passenger of a car is "seized" under the 4th Amendment (Brendlin v. California), and therefore would probably be able to challenge the stop itself.

Does anyone have notes from the simulated MBE analysis videos they'd be willing to send me? I hear theres a lot of little helpful tips he gives but I'm not going to have enough time to be able to watch most of them. I really appreciate it!!

As a side note: That doesn't mean that you never have an expectation of privacy in something/somewhere that belongs to someone else. For instance, an overnight guest would have an standing to challenge a search.

Some of these Crim Law fact patters are so silly. Like the D breaks into someone's home, has an unreasonable belief that the person's car belongs to the D, hotwires the car and drives it away. But OH NO he's for sure not guilty of larceny or burglary! Because he really believed the car was his! YAAAAAYYYY!!!!

I think it's also useful for the fact that the real MBE felt exactly like taking refresher, as far as how foreign the questions seemed. Stupid? Yeah. Impractical? Absolutely, but they're the elements of the crime... Have to suspend belief a little (or sometimes a lot) when you do these questions. It doesn't matter whether his belief was reasonable or not... Sometimes you just have to give them what you know they want. These BarBri exams are frustrating. I scored right on the button 57/100. The day prior I took an MBE OPE and scored a 75/100.
