I have a question about the MEE Workshop "myoutlines." When I click on them, they're blank. Is that normal?

I think this will not be the presumption because it doesn't give a durational limit. A FSD has time language. A FSSCS has conditional language, plus that required "right of re-entry" language.JJ556 wrote:I think what you've described "O to A provided that A use [land] as a farm," is a Fee Simple Determinable. O maintains a possibility of reverter -- the land automatically reverts back to O if A doesn't use the land as a farm.
By leaving off half of the FSSCS, I think the court would say it becomes ambiguous, therefore just a purpose. Therefore an FSA.
ETA: Especially because the possibility of reverter is a more powerful sort of future interest, so I think courts in general won't be wanting to give that to the grantor if there is ambiguity.

Re: Themis Bar Review Hangout - July 2014 Exam
That was my initial thought as well. However, I did a property essay and the interest granted was almost identical to that described above (it used conditional language rather than durational). The sample answer described the interest as being a FSD with possibility of reverter. I also looked at Example 1 on page 3 of the RP handout: "O to A so long as the land is used as a farm." This is considered a FSD. Perhaps it's a bad example, but I have a hard time holding that "so long as" can be durational language while "provided that" cannot be.puttycake wrote:I think this will not be the presumption because it doesn't give a durational limit. Finally got my graded essay back. Got the lowest score possible on every single category (1/6 x 3), and an overall score of "1," for a total of "4 points." My favorite part is how she told me to mention things in my answer that the model answer itself doesn't bring up even in passing.

Re: Themis Bar Review Hangout - July 2014 Exam
Thanks very much for your input on my hypothetical, puttycake and JJ556. (And sorry for my poor writing of it--supposed to be use of land, not use of O!) I see the justification for both of your positions. It seems plausible to me that it becomes a FSD since the possibility of reverter vests automatically. It also seems plausible to me that because it doesn't use traditional FSD language, it becomes ambiguous/purpose and therefore an FSA. These points are satisfying enough to me; I'd argue it if it comes up on an essay. It doesn't seem like the sort of thing that would come up on MBE. Thank you!!
On a side note, I've finally found a satisfying middle ground for keeping track of what I learn from lectures that I thought I'd share. Before I listen to a lecture, I copy the relevant summary outline section on it. Then, if anything is said in the lecture that I think is useful and is not sufficiently reflected in the summary outline, I incorporate it into my version of the summary outline. Also, if the summary outline puts something in a way that I think is unclear, I edit it to clear it up. This way, instead of having three documents--the long outline, the handouts, and the summary outline--that confusingly vary in wording, overlap, etc. I end up with one outline that gives me what I feel is truly a compact version of everything I need to know. And because I'm working with it along the way, the phrasing and presentation of everything is familiar and easier to digest during review. Ofc, do what works for you!
Edit: that sucks, Tanicius. I'm not expecting anything better on mine.

Mine was the opposite. "Why did you mention X? X wasn't an issue!" when the model answer said X. Bah!Tanicius wrote:Finally got my graded essay back. I'm with you on the low scores. I like to think we're just saving it all up for the exam.

Re: Themis Bar Review Hangout - July 2014 Exam
Hi everyone,
Much like last year's TLS thread, I will be periodically checking in on your (sometimes hilarious) posts. I am always going to suggest submitting any questions you have through your myCommunication tab but will try and answer any repeating topics and squash any rumors here. A few items to note;
- You can purchase the printed lecture handouts from Themis for $50. For those of you that have free printing, good for you. For those of you who don't, feel free to email info@themisbar.com to request the printed handouts. The fee will be added to your account. You will be able to pay online or call our office at 888-843-6476, Monday - Friday 8am - 6pm, CDT and Saturdays, 9am - 1pm, CDT.
- You can speed up video lectures on web browsers only. This functionality is not supported in the iOS default video player, which is what our app uses.
- We are always going to suggest following the program as it is setup, but you have purchased the course and the materials so how you leverage the course is ultimately up to you.
- Everyone at Themis is here to help you pass the bar exam. If you're having an issue, a bar prep freak out, or just need some help, please feel free to reach out to someone (whether it's through the myCommunication tab, phone call or email). Remember, we can't tout high bar exam passage rates without all of you passing the bar!
Good luck over the next couple of months and I look forward to reading the congratulatory messages here when the Summer 2014 results are released.

Thanks for all the help so far through your course! I have a completely non-substantive or technical question. It isn't bothersome or anything, and we don't want to burden the official communications feed, but I think everyone here wants to know the answer to this:
What is Sherman Clark doing when he looks to the side and talks off to the side? Is there a Themis staff member in the back or to the side ticking off a checklist, fetching his water, and giving him thumbs up signs as he chugs along? We need to know this.

Did someone say that Themis is going to be emailing the NJ/NY bar-takers the summary outlines this week or something? Because right now I can only access them (or what I think they are) when Themis assigns me a "review ____ law" task. Is this right or are you guys talking about something else? My bad if this has been answered already.
