Yea, I think that's one of those you may just have to remember (and probably will now). Also, an opposite rule is pretty much unworkable.

One comment on the civ pro essay I'm not submitting for grading because I don't feel like feeling frustrated 3 days from now.

what's up with the PJ discussion in the answer? It's structure is nothing like my answer.. i followed the contact, relatedness (general, specific), fairness analysis on the lecture handout.
How many pages do you guys usually write per question? sometimes I barely write a one-page answer, 1.5 tops

Do you mean the model answer? It looks fine to me. The only thing I will say though is that for general jurisdiction SCOTUS recently has completely done away with continuous and systematic activity. Freer mentioned this but the model answer still hits on it. The sole test is now whether the corp is "at home" in the forum state.

The analysis goes like this: general > specific > contacts analysis, while we were taught contacts > relatedness (specific, general) > Fairness (if specific). I guess it won't make a difference on the bar exam anyway.

PS I'm done for the day. worked on a few additional questions and Adaptibar decided to give me 10 questions with less than 40% success rate back-to-back. :?

It's a shame because I thought my fairness analysis of "Well, the plaintiff would really like to sue in this state. But consider: the defendant would not like that," was pretty incisive.

I kind of blanked on my fairness application. I made up some BS like "oh the forum wants to have the plaintiff sue here and the defendant Corp can afford to be sued there" some shit like that.

Random question regarding the mixed set: if the goal is 33/50, is that goal scaled to our progress as of July 5? Or is that goal the same as it would be if we took the same set on July 25? Basically, is it safe to say that if we're around or above passing scores already, we should be confident as long as we keep working that we'll be above passing in 3 weeks when we've had even more time to study the subjects?

In terms of the scoring rubric that Barbri gives us to mark essays, how close are these to what the bar examiners will actually use? Is this what we should expect? I appreciate that even when I'm fairly off the mark, there still usually seems to be more than enough points up for grabs to reaching the passing range.

One other question I have, and maybe someone can weigh in on this, is how closely markers will go by their rubric when marking. It's obvious that no one will be expected to hit the point on the rubric word for word, but I just struggle to know sometimes if my analysis fits into the point adequately enough to score a point. I feel like my analysis is correct, just formulated differently.

It's unclear, but know that Barbri will assign mixed sets on different weeks depending on which state you're taking. But if you're already around the passing score, I'd take comfort in that.

On July 17, 2015 Barbri tweeted that "the overall pass rate nationwide was 91% for students that completed 75% of the work" ... And clarified by saying "we mean 75% of AMP, 3 graded essays, did the Simulated MBE and 75% of PSP" (see https://mobile.twitter.com/barbri/statu ... 0614282240)

They also said that 98 schools had a 100% pass rate for students that completed 75% of the work, while 152 schools had a pass rate of atleast 90% that completed 75%

i went 40/50 today, missed 48 49 and 50. thought those three were some tricksters. but i have definitely seen a handful of those questions before today and vaguely remembered the answers, which is somewhat lame. very happy with the score but nervous about tomorrow

But does anyone do all the AMP even if it's not assigned as HW? Seems a bit pointless to do 75% of it.
