Well the breach of fiduciary duty would allow a recovery for that much, but charging under a criminal statute it's the amount initially converted.victortsoi wrote:nucky thompson wrote:moreheesh wrote:So when it comes to embezzlement, whats the correct way to measure the amount embezzled??

See I thought the total value, NY trusts has a similar concept. Lost opportunity...
Edit- I mean who gets the rest, certainly not the embezzler.

After the MBE, I feel like sentencing the Barbri CEO to a term of imprisonment beyond the statutory maximum based on an aggravating factor. Unfortunately, if the jury doesn't make that finding BRD, that would violate his constitutional rights... right?

I also spent like 4 minutes on that question trying to reason it out. There was one nuance to that question that made me decide it was a constitutional issue.
(Assuming you're making a reference to a certain similar question.)

Yeah, you basically treat that as an extra element of the crime, which must be proven beyond reasonable doubt.gmail wrote:After the MBE, I feel like sentencing the Barbri CEO to a term of imprisonment beyond the statutory maximum based on an aggravating factor. Let's agree that all of us will call them daily for progress on grading until results are released in protest.
But seriously, why does it take 2 1/2 months to grade this shit? Scantrons take an hour.

In Alabama they told us not to call for results before September 24th on penalty of death.

Why would you be on notice for seeing private property signs on private property? I am not saying you are wrong, just that I grew up in a place where every property had these signs in the country. The sign would just let me know someone owns the land, not that it had been conveyed to another prior purchaser.

In Virginia our handwriting sample was a statement stating that we would not call the Virginia Board of Bar Examiners to ask about our scores.jaysnooginz wrote:somuchbooty wrote:Let's agree that all of us will call them daily for progress on grading until results are released in protest.
