I don't get this question. I thought the President could choose not to spend federal expenditures unless Congress expressly says he must. What am I missing?

Question 26 - Constitutional Law - Separation of Powers

The question was:
Congress enacted a statute that authorized the construction of a monument commemorating the role of the United States in liberating a particular foreign nation during World War II. Another statute appropriated $3 million for the construction. When the United States became involved in a bitter trade dispute with the foreign nation, the President announced that he was canceling the monument's construction and that he would not spend the appropriated funds. Although the actual reason for the President's decision was the trade dispute, the announcement stated that the reason was an unexpected rise in the federal deficit.

Congress was saying the funds had to be spent for the monument - they provided $3 million for its construction and the president cannot go against that.

I guess I get it? If they say, "Spend $3 million on education" that's an example of something the President could choose not to spend the money on but if they say, "Spend $3 million on a new school located at X", then the President would be forced to use the money?

It's my understanding that in either case, the President would have to spend it as Congress directed because Congress specifically appropriated those funds for that specific purpose ... in both scenarios. Or maybe I'm not entirely seeing the difference in the former of the 2 scenarios?

That sounds insane. Who the fuck would ever volunteer to be a general partner at a limited partnership? They do all the work but front all the risk?

Anyone who’s offered a really high share of the profits without having to give up all that big of a capital contribution to become a member. That’s my guess at least. These people are the CEO types who love running stuff and making lots of money. They aren’t as afraid of risk as everyone else. But yeah, I don’t think I’d want to be a general partner, personally.

Corporations and LLCs can be the GP. 95% of the time in real life, you have a bunch of limited partners, and then a limited liability entity (usually single purpose) as the general partner.

These are pretty awesome summaries in plain speech, too.

On test day I'm just going to default towards the President needing to spend the money. Unless the question is really specific about Congress not allocating the funds. I'm too confused to get technical on this.

I've only done about 1200 MBE questions (including the simulations). Is that too few? I guess I need someone to tell me it's enough because obviously I don't have time to do much change lol.

Including the individual sets, mixed, milestone and simulated, I'm sitting at ~1800. I still have two sets of 50 available.

Also have that 'year 1' Barbri book from my 1L year. That FRCP video was a lifesaver.

Will I touch any of this stuff? Maybe. Could do a set of 50 on Monday/Tuesday. Will I? Meh.

Thanks, Tanicius. I'll definitely use this for First Amendment as I have a hard time remembering those rules. Unfortunately, or fortunately, the other subjects aren't tested in my state.

My hotel is nice too. Everything I could want and a nice couch. The only problem is that it's in Canada (about a 10 minute drive from the testing center in NY). So I have to cross the Canada/US border. I've already had the trunk of my car searched for contraband!

I'm leaving 20 minutes before I need to be there. That will give me an extra 10 minutes in case of heavy traffic. I went back and forth over the border 3 times today and each time it was different.

I'm not too worried. If I could have done it over again I would have stayed within the US and drove an extra 2 miles from where the other hotels are. Too late!

Your are in Buffalo too? I was pretty surprised by Buffalo in general. I've only been there once. About a half mile down the road from the testing center it gets pretty rough very quickly. Just a couple miles away from the testing center is the border. Yet it's located in what seems like a solid business district.

Lucky! I'm in Albany. I drove up today and checked out the site - the parking lot where I planned to park is tiny, so I have to get there early. But Buffalo was way too far - as I was driving up, I kept seeing signs for Albany and Buffalo. Albany: 80 miles, Buffalo: 360 miles.
