Well, for Civ Pro the guy said just use his outline. FINALLY, a lecturer who doesn't bullshit us and just makes our lives easier by giving us what we need. For con law, I would just use his outline, as long as you wrote down all those examples he talks about. The only reason I write my own outlines is because I like having a 10 page outline, instead of a 40-70 page outline. Its more of a mental thing. My brain is more disposed to studying shorter materials, even though its the same thing lol. But I haven't opened the CMR since the first week of lectures, and I think I'm doing fine without them.

ETA: the big outline books are only supposed to be used for clarification, like if you're having trouble understanding a certain rule

Wouldn't it depend if the guy was acting as the principal's agent? I guess if its an employee, you would have to see if he was acting as the employer's agent? My guess is that they would set it up as an employer running an errand for his employer, as opposed to any old employee who works in a store or something. So probably for agency it'll be a more one-on-one relationship type of scenario, but that's just my guess.
I noticed the CMR is missing this discussion on agency. If the bar simply talks about employer-emplyee I think I'll say that employees are always agents of the employer and the question turns on scope.

Is there any real reason to go to a live practice MBE if I can just do it at home?

Honestly, I don't think anything is like the actual test day. Even if you go into a live "recreation" you know its not the real thing, the adrenaline, the rush isn't the same. I guess maybe you can get a feel for whether or not you are bothered enough by others to need ear plugs or something like that?

So you may as well just do it at home.

We were, but you couldn't bring it inside the testing room, so you had to leave it outside with your bookbag and other stuff.

Target has those "Picnic to Go" boxes which are pretty indestructible and non-perishable and self contained in that one smallish box has everything you need (including tiny utensils).

I just ate in my car. It wasn't pretty, but it was so much easier.

What did everyone get on the simulated Barbri MBE today (non-NY)?

120/200 here. Not sure if this is good or failing.

I got 118/200.....I ended up with a 152 on the real MBE, IIRC.

They say the average 100-115, so I would be happy with 120

So what exactly is "passing" on the MBE? Barbri has the average Barbri score in the practice book, but says repeatedly that is over and above what you need to pass the MBE portion.

As a follow-up question; is "passing" on the MBE what you need assuming the "average" score on the other sections, or would just "passing" the MBE require crushing the other sections?

I'm finding this all a bit confusing :|

Eh it varied. Pretty close to that on some of the book sets but on some of the sets you do online I did really bad. Like less than 50-% on some of the evidence sets.

I had about a 13% boost on my simulated MBE compared to the Barbri practice sets.

I usually hover ~60% on my practice sets (generally at the benchmark or 1-2 Q's above), but returned a 147 on the simulated test.

The questions felt easier than the problem sets - fewer trick/unfamiliar questions, though there still were plenty.

Thanks, I am very pleased.

Trying not to get too confident and taking the foot off the gas; I'd rather over prepared than under.

But if I can replicate this score come test day, I will be happy as can be.

Good question. My bar mentor keeps saying I should go. I think I will, because it's going to be in the same place where I'm taking the bar, so at least I'll familiarize myself with the area so I won't be completely lost that day

I have a couple friends who said it was actually one of the most useful things they did. Essentially just understanding and testing in the atmosphere of a gigantic convention hall. One said he never used ear plugs during law school exams, but after the practice MBE knew he had to because of how noisy the room was. To each his own, I suppose. Mine's only 20 minutes out of my way, so I figure I might as well.

Thought I'd share a nice mnemonic I thought of (torts):

If you don't want to prove special damages in a defamation (slander) case you have to join the CLUB.

Crime
Loathsome disease
Unchastity towards a woman
Business interest.
