Also studying, during the best weather the DC has had in weeks. :( I wish I was a study-by-the-pool person, but I need a desk and 0 distractions. Trying to get through all the con law lectures + a few PQ sets today because of a bit too much time by the pool and grill yesterday...

I made myself leave my apartment to go study at a coffee shop today. I knew I wouldn't be able to take today off, but I didn't particularly feel like listening to everyone splash and have fun at my apartment's pool while I'm stuck inside working my way through lectures. Plus, I just really needed to leave my apartment for more than an hour, ha.

I absolutely have to get out of my house. If you're struggling with studying so far then I definitely recommend a new location.

I completely agree. I realized today that making myself get up and put on real clothes and look presentable, and then going somewhere with a little background noise but without the comfortable distractions of home is going to be very helpful to me. Of course, there are those days when I won't want to leave my place, but changing up location is really going to help me out, I think.

Only doing 1-2 hours today. Finishing up Property tomorrow, taking graded essay + starting torts. Property bro is pretty funny still, so not looking forward to switching to torts guy.

Anybody know exactly what the "suggested pace" means? Right now it's showing +1.6%... I'm assuming that means I am 1.6% behind the suggested schedule, but wondering if anyone can confirm/deny this...

The suggested pace is how much you are supposed to progress in a day/on that day, not how far you are behind. The third number is how much you have progressed that day.

Yep, I'm working a week+ ahead as well (surgery and cross country move in the middle of all of this, woo!) and my suggested percentages are still ~1.5% daily. The first intro lectures mention that as being the daily goal through the early part of the course so I think that is the same for everyone regardless of how far you've progressed.

A little bit, but then I just write the simplest thing and then more seems to flow after that! Ie "a contract is formed when there is an offer, acceptance, and bargained for consideration." Not so hard, but I can usually get the ball rolling if I start at the obvious!

Ask your advisor follow-up questions about their feedback. If they remain unhelpful, maybe ask Themis for another one. It's not uncommon to be stuck with a terrible advisor and it'll only get worse as they become inundated with essays. I wish I'd asked for a replacement.
good advice generally. i actually thought the feedback I got was pretty helpful (essentially, "your organization is sh*t"). Just to KD35's question, it would be interesting to know if they intentionally under- / over- score for motivational purposes.

I have the same problem, but then I just take a breath and read through it line by line trying to see any facts related to any issues. If I can't think of any issues, I go over in my head the rundown of that topic's main issues (for ex. in contracts, it's offer, acceptance, consideration, etc.)

One thing I do is right at the beginning I skip down to the questions at the bottom and then write my topic sentence exactly like Themis recommended. Like this:

Whether (rephrase question) depends on whether (state the general rule). (list more detailed parts of the general rule)
E.g.,

Whether Perry can be paid the undue rent depends on whether he breached the implied warranty of habitability.

I find that writing my topic sentences at the beginning breaks the ice and helps me build my essay around it.

Would someone mind sending me an outline they put together for Ks? I really want to narrow mine down to just the bare bones rules, but I worry I'll be screwing myself by basically ignoring some information. Just wanted to see how others were doing it.

Getting hung up on zone of danger vs. bystander recovery. This assessment question got me.

Which of the following is NOT required for a bystander plaintiff to recover for NIED as a result of witnessing harm to another?

A The plaintiff must be closely related to the person injured by the defendant.

B The plaintiff must have been present at the scene of the injury.

C The plaintiff must have personally observed (or otherwise perceived) the injury.

D The bystander must be within the zone of danger. (CORRECT)

So the answer is D, but couldn't a "bystander plaintiff" recover under either theory? Do I need to understand that the term "bystander plaintiff" refers to just that, bystander recovery, and zone of danger is entirely separate? I got the question wrong for a different reason (misread), but I'm still a bit confused about the relationship between the two theories, if any.

Yes, since the zone of danger is a prerequisite for a real party, by definition a bystander is not in a zone of danger.
