What needs to be taken into account during a partition hearing?
Maintenance and repair, taxes, and rent taken in on the property?
But not income taken from a business that was run on the property by a tenant in common?

I think there are some equitable factors too, like whether it's a property that can be feasibly divided. If it's a single garage, it's difficult to argue in favor of partition. Or if it's some old lady's house she needs to survive, again, how would you split it in half? Does anyone have a property/mortgage miracle solution? None of the explanations are good enough and by good enough I mean broken down into commonsense language my 11 year old sister would understand

I'm in a similar boat, currently at 44%. Hoping to hit 65% by the bar. Finishing last video this afternoon and then nothing but practice practice practice. Evidence seems like a foreign language but the others aren't too bad. Fingers crossed...legalmindedfella wrote:No excuse on the studying just poor planning and lack of responsibility. Did we ever get an answer as to whether the actual MBE questions are easier/harder than what we've been getting from Themis? I know a friend of mine said they were similar, but I didn't know if anyone else had further proof.

Anyone have any insight as to whether we should know about mortgage holders "in due course" and personal/real defenses to mortgages?
Other classes seem to go into them a lot, but Themis has a 4 line paragraph and that is it.

I'm with you there. I feel like I understand everything fairly well and I'm doing fine on the MBEs (for the most part), but I'm still scared shitless that I haven't memorized enough. I've never taken a closed-book essay exam so I hope I don't blank on the law for any of the essays.Prime wrote:86%. Now, if only the entire test was the MPT.... My MBE scores are still mediocre (at best) and rule memorization is poor.

I like Kapital's numbers for the most part, but I guess for me it would be less than 50% for terrified, 50-60% for okay, 60-70% for good, and 70% plus for thrilled. On the plus side, my MBE has shot up about 10% during the past two weeks. Consistently hitting in the 65%-72% range. Starting to see vast improvements in areas such as real property but torts has been all over the place.

I got a 139 and am devoting only two more days to MBE between now and the first day of the exam. I guess I feel OK. I bit the bullet today and started watching the simulated mbe videos. Watched the first two, took about two hours. Had gotten several 72%s in a row. Next one was 76. Might be correlated.
I feel better about the info though, and Ill be finishing the videos.

I actually watched them as well and found some 'positives' in the video. Played it at 1.5 speed and jumped around to questions that I got wrong. I know when I'm reading outlines/answer keys, my eyes tend to glaze so every little bit helps.
My evidence/property scores have gone up quite a bit since the simulated MBE and the subsequent review. Gotta be something in there!

I'm at 74%, but that's because I've taken time off of Themis assigned stuff to outline all of the state-specific subjects, as that's the only way I feel I'll learn them, and to go back and review all of the MBE questions I've gotten wrong. I'll probably end up somewhere in the low to mid 80s by test day, which I'm okay with. Also, a ton of what I haven't done is essays, and I've been killing the graded essays, so I'm fine with not doing close to all of the practice ones.chimp wrote:Out of curiosity, what percentage of the course have you guys completed as of now?
