It'd be a lot of booklets to print out and get organized with the test centers in a very short time frame...
That said, a new mix of questions seems to be the best way to ensure fairness. I happened upon the email from someone taking the exam this week; it says they are sending the memo "verbatim" to all registrants; the email doesn't say that those will ultimately be the subjects. It'd be a funky trick to now mix the fact patterns up given that people are now likely relying on the list. The fact remains, though, that all subjects were said from the outset to be fair game.

So, does anyone have any clue what the hell a Con Law remedy would be? Could it be a civil rights issue like due process and equal protection and then perhaps damages based on pecuniary loss? Or only equitable remedies? I've never seen remedies with con law!

Well, at least you guys know what not to bother with reviewing now.
I have a friend who was freaking out. But after talking it over, it doesn't seem like this should make much difference. It's too late. If you've prepared the best you can, you're okay. If you're gonna try and cram, well, good luck practicing and studying your ass off up until you have to leave your hotel room for the exam.
Anyway, as mentioned above, if you were sweating Corporations or Whatever, you can scratch that crap off your review list and get to the things you know are gonna be on the test. And that ain't bad.
As for the curve, that's another Whatever. You can't control it, so don't sweat it.
My most sincere best wishes to all of you.

Maybe they should make it a take home exam next year.
I just can't. They don't even have a press release on their website. This is one of the few jobs they have and either they fucked it up.....or someone is on the take.
Even that sadass email fails to say how many law school deans had this information and when they got the information. If they had the information for months that would be very helpful. But it isn't really all that helpful to students at this point.
IMO this is so big a screw up that people should resign and lose their jobs. They won't, but they should, what a shit circus.

Well in 2007, July they tested Con Law with murder, the guy that burned the declaration of independence. I've seen them test it with real property, the takings and the tort, nuisance dog/trespass and the guy that liked to smoke meat for his buddies. Who knows. If you have a bar review, talk to them on Monday morning.

If not, remedies and Con Law go well together. i.e. court injunctions (w/specifics, such as injunction requirements/elements and limitations) and the 14th Amendment.

Absolutely zero chance of this happening. It takes them weeks (if not, months) to write and finalize these questions, they can't reprint and distribute everything in time, and then they'd have to deal with the added fallout of a "head fake".DodgerBlues1991 wrote:Are we certain they can't just change the questions now?

The 2019 July California Bar Exam shall go down in history as the Black Sox World Series of 2019.
It is unfair, to say the least, that we went from a healthy learn everything and let's test your knowledge approach, to a dog-eat-dot s**t show. This will be all about who can present issues best. Who can fit the most in under the 10000 character limit.
I doubt anybody will be spending the time outlining.
No matter the fallout, some of us were privy to these topics before just a few hours ago. This is not ok, this cannot be ok, not under any circumstance.

I feel like I somehow learned that I have two days left to live and need to figure out what I can do with my time to fully take advantage of those two days.
Cannot memorize everything in those subjects and just pure torture that they sent that email on a Saturday night and had 3 DAYS to think about how to make this fair. 3 days that many "privileged" people had access to this info. I highly doubt this just happened for this bar exam. For the people only focused on commercial property and wills and trust and corporations, I am very sorry and understand myself how this time wasted feels. I happened to spend a day on the business association topics and really wish I could have that day back to learn Civ Pro California and Federal distinctions.
They should either throw out the essay day or change the curve on this exam to benefit more people because the people with the early access already had the advantage to pass so maybe others with less advantages and studying the wrong material could get leniency in the written score.
Overall, this is sickening. I wish all of you the best of luck. I hope all of us pass this bullshit.

Posting just as a thought for the ConLaw/Remedies essay.
Lots of injunctions, TROs, etc on Immigration have been in the news the past few years, especially with the Flores agreement.
Maybe briefly looking at some of those court opinions in how they use remedies in Con Law will be helpful, and look over plenary powers for executive branch on immigration and EQP for nationality issues.

Now they must show the error was immaterial and did not affect the outcome. To do this, after many calculations, the pass rate will be identical to July 2018.

Fucking around with the bar exam is fucking around with people's future. One of the biggest jobs the state bar has is to fairly administer this test. They can't even get that right. The test can be hard, but it should be fair.
I cannot imagine how examinees feel. I'm enraged and I already passed the bar.
