On the Problem sets we're being assigned in Study Smart, are you all timing yourselves or focusing on focused on just getting it right for now?

More recently I've been hitting or just above the targets for Torts and Crim law/Crim pro. In the beginning I was maybe one or two below target. Still reveiwing more property before I begin the workshop but got 23 out of 35 on the RP assessment.

Critical pass cards are arriving today so i'm excited for those.

So Barbri Will's lecture says a valid codicil can "bootstrap" an invalid will. Barbri's model answer for Wills Essay 1 says it can't. The Wills Essay also tests on a portion of the UPC that is not in the Conviser Mini Review, the MEE Outlines, or the lecture handouts. Thanks, Obama. :x

Wills and trusts in a nutshell says that there can't technically be a codicil if the will was not properly executed although many courts refer to the two separate documents, the invalid will and the purported codicil, as codicil and the will. Under the theory of re-execution, the codicil (which technically isn't a codicil) serves as a "bootstrap codicil" to validate itself and the will. The other approach is simply to treat both separate documents as one check if that cures the defect in the will. I think there should be situations out there where a codicil cannot serve to validate the will because of the defect in the will. Does this help?

To be honest, I don't know why barbri is having us spend so much time on this now. I've read that the MBE is really the most important section of the bar exam and that the essays subjects should be left for the last few weeks of study, since bar exam essay writing is mostly an issue spotting game.

Yea, I would prefer if we were getting MBE solid first, so I could start hitting Adaptibar, but I'm probably going to continue to try to follow the schedule for now.

I believe a little more than half of the MEE will likely consist of MBE topics. Crucial to hammer down the MBE topics before moving on to Wills or Partnerships.

what's B's interest called? vested remainder life estate?

i was just about to order critical pass, but was hoping they had it for the MEE only subjects as well. If there is a wills/trusts question on testamentory trusts that will be a lot to have to recall. work through all the elements of a valid will and if theyre met, then the elements of a valid trust and if theyre met. seems not that hard since I have specifically noted this in my mind, but there can be such specific stuff like this on a large number of things in these MEE topics it's just impossible to remember every element of every thing in case it comes up

I think you should be worried if you're aiming for the equivalent of an A in the MEE section but you're not. I've read getting a passing grade is pretty easy once you spot the issues and BS the rule.

Anyone else bomb the RP workshop? Feeling bummed. 14/25 :(

EDIT: I stopped after 20 questions. Went back ten minutes later and finished strong. 14/25. Still need to improve however.

Next week looks relatively light compared to this one. :)

I need it because I am so close to catching up. About 5% behind "assigned" from starting late. It was at like 12 or 15% when I started.

2-3 crim questions for today (set 4) are ridiculously bad. Especially the one dealing with premeditated murder. There's no way we'll have a similar fact pattern on the bar exam with that kind of fuzzy definition, especially when there's real inconsistent case law out there. I don't want to give any spoilers here but if you agree let me know. I know one of Barbri's strategies is to make us think we suck so we end up studying more than we have to but this is just ridiculous.

Have to agree on that premeditated murder question. I understand the fact pattern told us no manslaughter but whether the suspect had sufficient time to deliberate was such a close call. Don't think we will see something like that on the bar.
