what about Corporations/Agencies/Partnerships?BrokenMouse wrote:Word on the street is that contracts is likely not going to be on it.InTheWideLand I Walk wrote:well, I guessed property and civ pro right, AND I knew there would be interrogatories on the PT.InTheWideLand I Walk wrote:no, it will be:robinhoodOO wrote:Here are my predictions:
(1) Riparian Water Rights (No, seriously, water rights are a big deal in California)
(2) Community Property re ERISA & CALPERS Distributions
(3) UCC Articles: 3-9 (Look them up!)
(4) ConLaw: Amendment 27
(5) Bankruptcy law (they will throw you a hail mary, and this is it)
(6) CA Tribal Law. Know it
1- pure securities racehorse issue-spotter. this will set a nice tone for the rest of the exam.
2- civ pro, prompt says "answer under CA law" but you have to apply the eerie doctrine and realize u actually have to apply federal law so there are no CA rules (this apparently happened before on an exam). rules will be compulsory joinder, permissive counterclaim, supplemental jurisdiction, compulsory counterclaim, request for medical examination, discovery, and interlocutory appeals. it will be a racehorse exam you will probably not be able to finish on time.
3- contracts (UCC)/torts /property crossover question. question just asks "what claims can person 1 bring against person 2"
4- invasion of privacy/false imprisonment
5- the question will ask about riparian water rights, but there are 6 hidden constitutional law issues that you have to spot (i.e. equal protection/substantive due process, ect..)- will resemble February 2014 essay 4 in many ways.
6- a bunch of stuff will happen in the facts, the facts will be 5/7 of a page long, and the question will be "what actions of person x constituted violations of the fair housing act?"
and PT 1, task memo will say "draft 100 special interrogatory questions". 3/4 of the people will just start writing a memorandum of law, and they will fail leaving only 25% of people to pass, and those few people will get 80+ percent. don't ever go against the task memo, ever.
and pt 2 will be an objective memorandum of law involving constitutional law, give you 10 cases, but 5 cases are irrelevant, and the task memo will say you have to figure out implicitly which cases are "relevant" or else you automatically fail the exam.
so I guess were expecting contracts and con law thursday. hopefully not fair housing act on the essay, although u had to know it inside and out for the july 2014 MBE.

Re: CBX: Essay Predictions
you're throwing too many areas of law out and stressing me out. hahasoj wrote:idk why you keep predicting conlaw but i'd be very surprised. crim pro and con law almost never get tested in the same administration. plus we've already had 3 mbe essays. if another mbe showed up (which i doubt) i'm guessing Ks/torts (maybe with remedies) or evidence. i've ruled out crim because crim and crim pro separately in one administration also sounds highly unlikely.
i would guess
corps or psp
pr
trusts, wills, or cp
or maybe
corps/pr
trusts, wills, or cp
Ks/torts with remedies

Re: CBX: Essay Predictions
Why is it predicted that wills/trusts, contracts, and remedies are unlikely? Is it because they were tested in Feb?

There were two separate contracts remedies essays in february, one a UCC contract, the other a land-sale contract. Wills/trusts was on there too.SpAcEmAn SpLiFF wrote:Why is it predicted that wills/trusts, contracts, and remedies are unlikely? Is it because they were tested in Feb?

Re: CBX: Essay Predictions
Quick question.
If I remember right, I remember someone stating on here that they will post the July essays on the website prior to giving applicants their fate. Is this true? If so, with sample answers?
The wait is definitely more brutal than the studying. But, as many say in the office, not knowing your fate is sometimes the best thing--it's like being in custody with the slight hope of getting out!
Thanks!

When the CA Bar releases the actual essay questions, there is a professor and bar course provider that provides "model" answers. His company is called Bar Secrets. They have a Youtube where they review the essays, Facebook, and a website.healthnut wrote:Quick question.

Apparently CA doesn't have a set date for when they release the Q's, but it's supposed to be any day (September or October).
