I've been trying to stay honest with the assignments, (ie not marking something finished I didn't do) and I'm at 39% of 50%. I have a ton of "lamp" personal assignments that I've been doing that I don't think factor in, but who knows.

Yea, they don't count the personal assignments. I haven't been doing those, and I'm at 41%. So I was doing a question set from a release NCBE MBE Sample Test Question sheet and this was one of the questions/answer. It was a K for services with a modification. Yeah, the essays and MPTs are why I'm really behind as I want to make a good faith effort to write it out.
I wouldn't discount the personal assignments though. I've started to do them and the AMP stuff is really helpful.

Is anybody up for meeting up after the simulated exam next week to go over right/wrong answers? It obviously wouldn't be the day of the test, maybe a day or two after. I know for some people (including me) talking to others about our answers is beneficial. I know we are given explanatory answers and analysis videos but this can be done before we read/watch those. I'm up for hosting this at my place in Queens (beer and food included) but I'm also willing to travel. Feel free to PM me.

Yeah, the "full chance to litigate" thing only comes in when you're looking at nonmutual issue preclusion. There's probably some ridiculous hypo where the distinction might be meaningful, but it pretty much restates the obvious. just an FYI Adaptibar's civ pro questions seem to be either easy or ridiculously tough (there is this hidden rule that's no where in our Barbri materials). I was extremely happy about my overall average and then it dropped 4% (still better than in Barbri though; barbri questions are more difficult on average). But hey! it's fun, for example, to learn that issue preclusion may be invoked even when the issue was decided originally in equity in federal court (bench trial; so no jury) and there's no 7th amendment violation simply because the SC said so.

I'm in a non-NY UBE state and tomorrow scheduled is the 50 questions, and the next day is the 200 questions. Tbf way too behind to even want to do the 200 question diagnostic yet
