Just did the first graded essay on K's.
Well that was a shitshow. Got 1 of the 3 substantive areas correct according to the model answer. Royally fucked 1 area up, and maybe halfway got the other one down.

I didn't notice any NY distinctions on the graded essay. They say in the model answer that "under NY law" ... but I was confused because I thought those areas indicated mirrored the common law. Idk I'll wait to hear what the grader has to say.sd5289 wrote:Just did the first graded essay on K's.

It was back in the doctrine of mitigation section of the K's lectures. The assessment question was one of those "which of the following is false" questions. I chose the answer that a failure to mitigate damages prevents the non-breaching party from recovering damages (which is false; it merely reduces the recovery they could get). The other option I had was that the breached against party must take reasonable steps to mitigate damages (which is true). The other two options were both of these answers are false or neither of these answers are false.
The assessment told me I got it wrong, and that the option that the breached against party must take reasonable steps to mitigate damages was the correct answer. I double-checked the prompt because my first reaction was "oh I guess I just read the question wrong," but it definitely said which of the following are false. So when I emailed them about it, the answer I got back confirmed that failure to mitigate does NOT bar recovery, but they didn't really address the fact that the assessment told me I'd gotten it wrong when I'd selected the correct answer for a "which of these is false" question.

Passed July 2014 in MI, now studying for CA. Evidence guy for CA is driving me crazy, talking about objections and motions in limine and a bunch of other stuff that is NOT on the MBE.
I've half a mind to dig up my notes and everything from last summer, but I know that's really just a procrastination method.

I'm working full-time, so I started studying weeks ago. This is also the 3rd and 4th time I'm seeing some of this material, so all my non-California specific lectures are 2x speed.

Also, IDK if it was mentioned in this thread, but Critical Pass Flashcards are like $100 for the physical cards, but are also available in app form for $50. Requires iOS though, so only useful if you have iPhone or iPad.

I am doing flex-study but started studying a few weeks ago b/c I work full-time. I think I'm doing okay pace-wise, but just want to be sure. How much of the course %-wise has everyone done at this point?

I'm at 11.7% as of right now. However, I have like 5 more tasks left and I'm not sure how much they'll contribute to my actual percentage at the end of the day.
More useful details: I started four days earlier for my program, but I didn't do as much as I should have the first week (so maybe these two things average out somehow?).

That would make more sense, but they are the MBE Evidence lectures...meh.

I am getting VERY tired of finding out about an exception to a rule or a rule exception in the goddamn answer explanations in the MBE practice sets. I've missed five questions because of this where I'd initially picked the right answer, but didn't know about the rule I hadn't heard of before until I click "submit answer".

TYFT. I am now going to go find some type of alcoholic beverage. That was practice set #3 in K's, and I've matched my best score of 58% correct (which was practice set #1...practice set #2 was 55%). This is going to be a long summer.

After struggling with the iOS and Google Play apps to download videos but uggh there's no speeding it up and there's no directed study...
In Firefox, there's a plugin called Video Download Helper. Once you have the video open on the web, you can download the .mp4 file and do with it what you will! Now I can play them in VLC on my various devices. *phew*
