Delegation: One guy unilaterally asks someone else to do his job as required in the contract. So I agree to paint your house and I hire some people to help, I'm delegating some or all of my duties to them but I remain on the hook.
Novation: Both parties agree someone else will take over for one of the parties. So I agree to paint your house then we find out a better painter is available so we mutually agree to swap in the better guy for me. I'm now off the hook.

Can anyone explain Question 10 in Contracts MPQ Set 5? I thought the correct answer was (A), but it's (B). I don't understand why the seller has an opportunity to cure. I just don't agree with Barbri's analysis of the facts, I guess. First of all, one button missing on a $12,000 coat doesn't seem like a minor defect to me. And I don't understand why the seller could have reasonably believed it would have been acceptable.

So, this probably just show my complete lack of understanding of the Rule Against Perpetuities, but would anyone be willing to explain why Question 12 of Real Property Set 5 isn't subject to RAP? BARBRI didn't even mention it, so I'm guessing I missed something pretty obvious.

Someone else should check my work here, but here's my analysis: The devise is "subject" to RAP but doesn't violate it. It's subject to RAP because it includes two contingent remainders (actually, a contingent life estate and a contingent remainder). It doesn't violate RAP because everything must vest or fail within lives in being (you don't even need the +21 years here). The contingent life estate in the eldest of the 2 grandchildren will vest, if at all, when the daughter dies. The contingent remainder in the eldest surviving offspring is limited by the language "at the death of the last life tenant. So, it will vest when the eldest of the 2 grandchildren (who are alive now) dies.
