IL lecture said in all likelihood it will not be a standalone subject, most likely in conjunction with secured interest. Honestly if you are crunch on time, it would be one of the last subject to be worried about I suppose.Devlin wrote:JFC how does anyone understand commercial paper? I have secured down pat since I took it last semester 3L year.
I'm probably just going to roll the dice and hope they ask one one of the two commercial paper topics that actually makes a bit of sense to me.

In Ohio they only test on one essay topic twice. In looks like February it happened to be Commercial Transactions and they had an essay for Commercial Paper and a separate one for Secured Transactions. At least the odds of a repeat of that are low...Devlin wrote:JFC how does anyone understand commercial paper? I think they're constitutional if they enhance the sentence based on motivation. But they're unconstitutional if they actually criminalize hate speech directly based on any kind of viewpoint or subject matter. In theory, a statute that criminalized all "fighting words," with no viewpoint or subject matter discrimination, could be constitutional, except it would almost certainly be void for vaguenessvictortsoi wrote:doing the con law amp and im unclear- hate crime statutes are invalid?

How many fully written out essays are people doing per subject? How many outlined? My PSP seems to assign 2 to write out and 2 to outline per subject and then broad review days at the end to 'review and outline additional essays for X subject.'

Opens PSP. Assignment says "MEET: Outline and Self-Grade Additional Constitutional Law Essays"
Sure, I say. Sounds good to me. I kinda like Con law.
Opens MEET book:
"No additional questions are available for Constitutional Law since Constitutional Law has only recently been tested on the MEE."

So in all likelihood we will not see Commercial Paper or Secured Transactions on the July test? Or we are guaranteed to only see one?charlesxavier wrote:In Ohio they only test on one essay topic twice. For those comparing BARBRI Qs to other metrics: I did 125 on the Sim MBE & just got a 146 (77% correct) on an Emanuel's test. Looks like the BARBRI simulated was harder by the "15-20 better on the real-thing" statement.
I need 266 in IL. Looks like a 146 raw comes out to about 158. If I can reach that, a 108 on essays gets me there--or about 2nd percentile. At this point, I think the MBE-first strategy is the real deal.

I also think that people get so concerned about essays, but dont fully realize that if you know that MBE material that well, your ability to do well on essays will evidence itself almost inherently. Thus, if you can ascertain that an essay question is requiring some sort of Equal Protection analysis based on a non-suspect/non-quasi-suspect classification, typing "rationally related to a legitimate government purpose" "14th Amendment" and "burden is on the challenger" probably gets you well past a whole lot of other applicants. Typing relevant legal words that are in the ballpark often will take us essay writers who are concerned further than we know, because we must realize that some people taking this test wont even how to approach the issue. Those people who can't find the issue are often the ones coming up way short on the MBE portion as well.DportIA wrote:For those comparing BARBRI Qs to other metrics: I did 125 on the Sim MBE & just got a 146 (77% correct) on an Emanuel's test. Awesome. Keep it up, see what you did wrong on the Emanuel's, and write jiggerypokery/pure applesauce on the essays.DportIA wrote:For those comparing BARBRI Qs to other metrics: I did 125 on the Sim MBE & just got a 146 (77% correct) on an Emanuel's test. Is there any way to see what was your original submission on the MBE? I scored by hand and found that I got 120 on the MBE, and BarBri shows 118. Considering that it is a late hour and I might have missed something or messed up while transcribing my answers from the scantron, I will not be surprised either way.

If you're in Texas, you're likely to see one of each. As far a commercial paper, I didn't have a clue after the lecture. The CMR is what got me back on track.3LOL717 wrote:So in all likelihood we will not see Commercial Paper or Secured Transactions on the July test? IL too and we have about the same score on sim MBE. Haven't tackle Emanuel yet. I think my strategy at this point is keep pounding away on MBE and hopefully bring it closer to a 130+ raw. And though knowing a strong MBE will likely carry me over, If I am being honest with myself, essays terrify me. MPT, whatever, everyone can write something about MPT. But that 9 essays, what if I just completely blank out... at least 6 of them are MEE and they cannot all be family law... right?DportIA wrote:For those comparing BARBRI Qs to other metrics: I did 125 on the Sim MBE & just got a 146 (77% correct) on an Emanuel's test. May or may not have bought myself some metallic ink Pilot G2 pens to make studying 0.0002% less terrible. It's the little things, right?

Re: BarBri Bar Review Hangout - July 2015 Exam
I just did a business associations question from yesterday's BARBRI assignment (in Texas if that matters).
Essay #22.
The model answer says "Partners may not eliminate their duties of loyalty, care, and good faith;..." but the CMR says (p. 5 in Partnerships and LLCs) that "The partnership agreement may limit or eliminate a partner's liability to the partnership or other partners. However, a partner's liability for the following acts cannot be limited: (i) beach of the duty of loyalty; ...". My notes have the duty of loyalty cannot be eliminated but that the other two can. Can someone clarify?
Thanks.

^ Nice. I rock the Pilot Precise V5 (in blue, of course). Real responsive. Fills in scantrons with little to no effort, which is important to me.kyle010723 wrote:That would depend strictly on the color of the inkrinkrat19 wrote:May or may not have bought myself some metallic ink Pilot G2 pens to make studying 0.0002% less terrible. They write just like a regular G2 (which is to say, quite nicely), and the ink is quite pretty. I am pleased. Is there anything worse than a scratchy ballpoint or rollerball? shudder.
My usual go-to pen is a Pilot B2P 0.7, or the Uniball Jetstream Sport. Both write like a dream. Been using a red Jetstream for correcting practice MBEs.

I've gotten supremely OCD about things lately though since studying for the bar. Can't use a different pen. Won't use a different shaving cream even though I kind of want to. Watch one episode of the same show every night before bed, drinking one of the same beer.
Kind of losing it.

Wait? We are supposed to use a ballpoint on the bar? I was assuming a #2 pencil like every other test. Guess I should've pay attention to the instruction and better go find myself a lucky pen...

Pretty sure the MBE day is (non-mechanical) pencils only. Oregon allows pens & highlighters on the writing day.
