Srsly for commercial paper just memorize what is is (the elements) and what a holder in due course is

For the essays I feel like I can for sure spot the issues, I sort of know the relevant tests/ elements although I certainly don't know all of them, and then I plan on elaborating and making stuff up based on those elements and tests. Am I fucked or is that pretty much what everybody else is doing?

Minus not knowing all of the tests, this was always my strategy in law school and will be my strategy on the bar, where I certainly won't know all of the tests. I'm going to try and focus on FL and attempt to expose myself to as many essays as possible between now and next week.

Okay whew glad others who are studying hard feel like this. Like you mentioned, in law school it's possible to know everything so it's difficult to accept that I just won't know every single test going into the exam.

Man...I'm doing the opposite (except for Florida Con Law). I've noticed that you can get most of the points on an essay just by going with MBE law and not even really talking about state specific stuff. Am I wrong?

I think you're right, but there are weird property/ tort distinctions I am paranoid about.

There are some basic tort distinctions that I bet they expect you to know, like that there is no joint and several liability in FL. As far as the "licensee by invitation" thing and such, that seems less important.

Two questions for you guys:

1) Did anyone else go "wtf" when they first saw the products liability tort questions? I am learning that stuff but when I first saw it I freaked out. I recognized some of the warranty stuff from Ks but not torts.

2) Did the cap on non-economic damages get overturned? The BarBri essay lady went over that stuff, but hasn't that been declared unconsitutional?

1) Yes! That's why I've spent a lot of time reviewing essays in the past couple of days. I did a lot of MBE work and feel solid with that, so, with the exception of two hours every morning, I am solely focusing Florida.

2) I thought that the caps for non-economic med mal damages were overturned as unconstitutional this past (I think the month was) March. This kept coming up in different lectures, and, assuming I'm correct, I'm so happy. Did not want to memorize anything else.

Alright, the primary essays that worry me are family and Florida constitution. The former I don't know how to approach unless they specifically tell us how to answer and the latter is just too damn much, ESPECIALLY when it comes to taxes.

Can you give me an example of an essay with a taxation problem? The only ones I've come across had a small thingy about only the local governments being able to tax real/ personal property but not much else, what am I missing?

And dude lol if you can do property and secured transactions you can do family law. All you need to know is equitable distrbution and best interests of the child and that will get you 75% of the way on any family law essay.

Just a correction, I think (and I'm also making sure that I have the law right)...I think under Florida law for negligent and reckless acts, only several liability is available, but for intentional torts, joint and several is available.

How the heck is it possible to remember all these distinctions and rules? I really just want to get a 45 on each essay and hopefully pass but looking at these model answers I doubt I would be able to do that.

Are you taking a bar prep course/is someone grading your practice essays? Anyway, you don't really need all the random distinctions and shit to get a good score. If you think about it, even if you completely miss 10 distinctions, that's just 10 points you're missing out on.
